ORDER (ORAL)

In the present Original Application, filed under Section 19 of the Administrative Tribunals Act, 1985, the applicant has prayed for the following relief(s):

“(i) That the Hon'ble Tribunal may graciously be pleased to pass an order of quashing the impugned order dated 10.12.2022 (Annex.A/1), declaring to the effect that the same is illegal, arbitrary and against the rules and consequently, pass an order directing the respondents to grant the full medical reimbursement claim of the applicant i.e. the balance amount of Rs.13,34,499/- in respect of the claim for the period 19.05.2021 to22.06.2021 with interest from the date of submitting the bill till date of payment.

(ii) That the Hon'ble Tribunal may further graciously be pleased to pass an order directing the respondents to consider and to grant the medical claim of the applicant in respect of other two bills of Rs.1,74,015/- (period 30.04.2021 to 08.05.2021) and a claim of Rs.61294/-(period 23.08.21 to 19.11.21 with interest from the date of submitting bill till date of payment.

iii) Any other relief which the Hon'ble Tribunal deem fit and proper may also be granted to the applicant along with the costs of litigation.”

Highlighting the facts of the case, learned counsel for the applicant submits that the applicant was appointed as a Postal Assistant in the Department of Posts on 09.03.1989 in Gurgaon Division and was subsequently promoted to the post of Sub- Postmaster. He superannuated from service on 31.01.2022. On

19.05.2021, the applicant was admitted in Paras Hospital, Gurugram, in an emergency condition. He underwent emergency endoscopic lesion removal surgery under general anaesthesia on 20.05.2021 and remained hospitalized until 22.06.2021. Thereafter, due to complications, the applicant was again admitted for emergency treatment from 13.06.2021 to 20.06.2021. He was subsequently hospitalized once again from 22.07.2021 to 23.07.2021. The applicant, through his family members, immediately informed the department about his emergency hospitalization. The respondents released an advance medical amount of ₹4,00,000/- directly to the hospital vide cheque dated 24.05.2021. He submits that the total medical expenditure incurred by the applicant for treatment between 19.05.2021 and 19.08.2021 amounted to ₹16,74,499/-. The applicant submitted his medical reimbursement claim on 22.08.2021 in accordance with the applicable rules. In addition, two further medical claims were submitted: one amounting to ₹1,74,015/- for emergency indoor treatment taken from 30.04.2021 to 08.05.2021, and another amounting to ₹61,294/- for follow-up treatment during the period from 23.08.2021 to 19.11.2021. Thus, the total medical claim submitted by the applicant was ₹19,10,216/-. The respondents obtained a second medical opinion from the Civil Hospital, Gurugram, which, after examining the medical records, opined that the treatment provided to the applicant was in accordance with standard medical protocols and applicable guidelines. Despite repeated representations made by the applicant, the respondents, vide impugned order dated 10.12.2022 (Annexure A/1), sanctioned only an amount of ₹3,40,000/- towards medical reimbursement and rejected the remaining claim without assigning cogent
