ORDER

Present OA has been filed by the applicant under

Section 19 of the Administrative Tribunals Act, 1985 seeking

following relief:

“(a) Summon the original records of the case.

(b) Set aside the impugned Office Memorandum File no.

A.20014/3/2006Estt. 8330-8332 dated 01.11.2023 issued

by the respondent no 1/NHRC, in the facts and

circumstances of the present case and in the interest of

justice and consequently.

(c) Pass an appropriate order, or direction, directing the

respondent no.1/NHRC to grant the coverage to the

applicant under Old Pension Scheme of Central Civil

Service (Pension) Rules, 1972 as per Office Memorandum

No. 57/05/2021-P&PW(B) dated 03.03.2023 with all

consequential benefits and in the fact and circumstances

of the present case and in the interest of justice and

consequently.

(d) Pass such other further order(s) as this Hon’ble

Tribunal may deem fit and proper in the facts and

circumstances of the present case.”

2. Factual Matrix

2.1 The learned counsel for the applicant states that in the

instant case, the respondents issued the advertisement on

23.06.2003 and the Written Examination was held on

27.10.2003 and Skill Test was conducted on 15.01.2004. The

applicant was declared successful in on one of the reserved

panel list which was prepared in pursuance to the said

written test and skill test. She was offered appointment on

basis of her merit in the reserved panel and she joined with

the respondents as Stenographer Grade-D on 19.09.2006.

Subsequently, the applicant gave technical resignation to the

respondents i.e. NHRC and joined the Ministry of Railways on

08.10.2008. The respondents issued the Office Memorandum

dated 03.03.2023 giving one time option to all Central Govt.

employees who have been appointed against the post/

vacancies advertised/notified for recruitment on or before

22.12.2003 to migrate to the Old Pension Scheme. The

applicant made representation dated
