ORDER (Oral)

Per Hon’ble Mr. M.S. Latif, Member (Judl.):- Through the medium of the instant O.A., the applicant has sought for the following reliefs:

a. That the impugned clause (g) condition no:1 of circular dated: 17.11.2025, (Only Doctors who are up to the age of 42 years shall be allowed to undergo tenure postings).This condition of circular is against the basic rule ie, NMC Notification dated: 30" June 2025 which prescribes the upper age limit for appointment of Sr. Resident in broad super specialty shall be forty 50 years thus deserves to be declared invalid, consequently the applicant be provided NOC for competing selecting process for tenure posting (SR. Residency 2026), as same shall be in the interests of justice.

b. Any other order or direction which this Hon'ble Court may deem fit in the circumstances of the case may also be passed in favour of the petitioner and against the respondents in the interest of justice and equity.

2. What emerges from the pleadings made in the O.A. is that the applicant is aggrieved of the conditions as imposed Circular No. 11-JK (HME) of 2025 dated 17.11.2025, particularly in Column I under the heading, 'Procedure/Calendar to be followed'. 3. Learned counsel for the applicant has challenged the above said condition on various grounds as have been urged by the applicant in the O.A. He submits that in terms of the National Medical Commission, notification dated 30.06.2025, the upper age limit for appointment as a Senior Resident in broad super specialty shall be forty-five (45) years and further submits that in terms of Article 254 of the Constitution, when any State law conflicts with the Central law, the Central law prevails and the State Law bec
