Standing Counsel O R D E R Per Kumar Rajesh Chandra, A.M.:- This OA has been filed by the applicant seeking the following relief:- SURYAROOP Digitaly signed by SURYAROOP KABI DN: C=IN, O="CENTRAL ADMINISTRATIVE TRIBUNAL, PATNA BENCH", OU=govt, Phone=4f29e5d1dcfbce8b0afeb88c04f365f9394705d2f5ab832fd6c09841fe7c96ed, “(a) That your Lordships may graciously be pleased to quash and set aside the impugned Order dated 11.02.2019 as contained in Annexure-

A/4 issued by the Respondent No. 6.

(b) That your Lordships may further be pleased to direct/command the Respondents to accord/release/pay the monthly pension to the applicant upon his superannuation from service on 28.02.2019 with all consequential benefits.

(c) That your Lordships may further be pleased to direct/command the Respondents to pay the statutory interest on the aforesaid amount from due date till the date of its actual payment without any delay.

(d) Any other relief or reliefs including the cost of the proceeding may be allowed in favour of the Applicant along with all consequential benefits.”

2. The applicant’s case, in short, is that he was initially appointed as Casual Labour through due process of law on 23.10.1984. He was subsequently granted Temporary Status from 27.09.1993 vide order dated 06.02.1995 (Annexure-A/1). After completion of three years’ service under Temporary Status he was declared at par with temporary Group-D employee w.e.f. 27.09.1999 vide order dated 08.05.2000 (Annexure-A/2) and till date of filing of the instant OA he was working under the respondents with all benefits. As the applicant was due to superannuate from service on 28.02.2019 the applicant submitted representations including dated 11.02.2019 (Annexure-A/3) for grant of pension and other consequential benefits. The applicant was then shocked to receive one order dated 11.02.2019 (Annexure-A/4) whereby and whereunder the applicant was denied monthly pension and other consequential benefits on the ground that he is Temporary Status employee which, according to the applicant, is not only inhuman, bad in law, unjust, SURYAROOP Digitaly signed by SURYAROOP KABI DN: C=IN, O="CENTRAL ADMINISTRATIVE TRIBUNAL, PATNA BENCH", OU=govt, Phone=4f29e5d1dcfbce8b0afeb88c04f365f9394705d2f5ab832fd6c09841fe7c96ed, unconstitutional, arbitrary, unsustainable but also against various judicial pronouncements of Hon’ble Supreme Court, Hon’ble High Courts and different benches of the Central Administrative Tribunal including Patna Bench. Hence, the OA.

Per contra, the respondents in their written statement have submitted that the applicant was given temporary status w.e.f. 27.09.1993 vide office memo dated 06.02.1995 and temporary status at par with Group ‘D’ employee w.e.f. 27.09.1999 vide office memo dated 08.05.2000 for entitlement of all kinds of leave admissible to temporary employee, holidays as admissible to regular employee and counting of service for the purpose of pension and terminal benefits as in the case of temporary employees appointed on regular basis who are
