ARUN O R D E R Per:- Rajinder Singh Dogra, Judicial Member The applicant had filed SWP No. 319 of 2018 before the Hon’ble High Court of Jammu and Kashmir at Jammu seeking the following reliefs:-
“Mandamus, commanding upon the respondents to regularize the service of the petitioner from the date 7 years of service has been completed by the petitioner as daily wager in MFP Project Jammu-Kathua range & any other writ, order or direction along with all consequential, pensionary benefits.”

After the reorganization of State of Jammu and Kashmir into Union Territory of Jammu & Kashmir and Ladakh and in view of the Notification No. G.S.R. 267 (E) dated 29.04.2020 read with notification No. G.S.R. 317 (E) dated 28.05.2020 issued by the Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training), the jurisdiction to adjudicate upon the lis regarding service disputes of the employees of UT of J&K and Ladakh was conferred upon this Tribunal and while considering the said fact, the record of Service Writ Petition No. 319 of 2018 was ordered to be transferred by the Hon’ble High Court to this Tribunal on 26.08.2020 and renumbered as Transferred Application No. 7606 of 2020.

The brief facts of the case, as stated in the Transferred Application (in short T.A.) are that the applicant came to be engaged as Daily Wager on 01.03.1993 under the Work & Plan/Circle MFP Project, Jammu-Kathua range and since his engagement has been working in the department as a Daily Wager and has been getting the ARUN wages prescribed by Respondent No. 1 from time to time. On completion of requisite seven years of continuous service in the year 2000, the applicant along with other daily rated workers represented before the respondents for their regularization in terms of SRO 64 of 1994. The Principal Chief Conservator of Forests, Jammu & Kashmir, Jammu recommended the case of the applicant along with other workers to the Administrative Department vide communication No. PCC/F/N/G/6 Pin JORINALIOR/602 dated 16.03.2013 for regularization, however the administrative department did not take any action on the same. Whereas, similarly situated persons namely, Kuldeep Kumar, S/o Shamboo Nath posted at MFP Project, Jammu, Kanshi Ramn, S/o Amar Nath posted at MFP Project, Jammu & Chander Prakash, S/o Khajan Chand posted at MFP Project, Jammu, have been given the benefit of SRO 64 of 1994 in the year 2000 and their services have been regularized. Aggrieved, the applicant along with other daily rated workers approached the Hon’ble High Court of Jammu & Kashmir by filing SWP No. 2487 of 2013, seeking regularization of their service under SRO 64 of 1994. The aforesaid SWP No. 2487 of 2013 was disposed of by the Hon’ble High Court vide order dated 20.11.2013 with direction to respondents to accord consideration to the claim of the petitioners in the light of the averments made in the petition, documents, appended thereto, having regard to the treatment given to the similar
