1. Present original application has been filed by the applicant

under Section 19 of the Administrative Tribunals Act, 1985,

seeking following relief:-

i. Impugned orders dated 09.03.2023 (Annexure A-4) may

kindly be quashed and set aside and applicant be

permitted to submit his option for pay fixation under 7th

CPC in accordance with Government of India Circular

dated 04.07.2023 (Annexure A-2) and 13.07.2023

(Annexure A-3). Accordingly, the pay and allowances to

the applicant may be directed to be revised in accordance

with option so exercised and consequently his retiral dues

may also be revised and he be granted all consequential

benefits in accordance with law.

2. The applicant was initially appointed as Junior Engineer-II in

the respondent department in the pay scale of Rs. 1400-

2300/- w.e.f 17.12.1990. He was confirmed in service w.e.f.

17.12.1992. Though, applicant was appointed Trainee Junior

Engineer he performed duties of Regular Junior Engineer

from the date of his initial joining 17.12.1990.

3. Respondent Department issued ACP Scheme dated

01.10.1999, providing for two financial upgradations in case

an employee is not granted promotions and accordingly

applicant was eligible for grant of ACP benefits w.e.f.

17.12.2002. The respondents also issued MACP scheme

dated 10.06.2009, according to which applicant became

entitled for 2nd MACP and 3rd MACP in the pay scales of Rs.

9300-34800/- and grade-pay of Rs. 4800/- and 5400/-

respectively. It has been submitted that since applicant was

denied above benefits, he filed Original Application No.

1122/PB/2013 claiming 1st ACP w.e.f. 17.12.2002 in the pay

scale of Rs.6500-10500/- and 2nd MACP w.e.f. 17.12.2010 in

PB-II i.e. Rs.9300-34800 with GP Rs.4,800/- with all the

consequential benefits and interest thereon, which was

allowed by quashing the impugned order, to the extent, it

denied the applicant benefit of ACP/MACP taking into account

his revised pay scale on account of restructuring. The

respondents were directed to carry on the necessary exercise

to grant ACP/MACP within a period of three months from the

date of receipt of a certified copy of the order (Annexure A-
