ORDER (ORAL)

Hon’ble Mr. Manish Garg, Member (J):-

By way of the present O.A. the applicants have sought the

following reliefs:-

“8.1 (i) To quash and set aside the Advertisement No.

2/2023 dated 31.7.2023, to the extent that the same does

not incorporate the age relaxation clause for the post of

EVGC (Male) (Post Code 66/2023) and EVGC (Female)

(Post Code 67/2023), as per the directions of the Ld.

Tribunal passed in O.A. 287/2018 and/or in the

alternative, direct the respondents to treat the age

relaxation clause as onetime measure, deemed

incorporated and read into the advertisement

notification, in compliance of the directions of the Ld.

Tribunal passed in O.A. No. 287/2018;

(ii) to direct the respondents to grant age relaxation to

the applicants and allow them to apply and participate in

the selection process and not to reject the candidature of

the applicants for the post of EVGC on the ground of them

being over age;

8.2 Any other relief that the Ld. Tribunal may deem fit

and proper in the facts and circumstances of the case.”

2. Highlighting the facts of the case, learned counsel for the

applicants submits that the applicants had approached this

Tribunal challenging the recruitment process pursuant to

Advertisement No. 02/2023 and seeking age relaxation, along

with a prayer to permit them to participate in the selection

process. Considering the urgency involved, this Tribunal, vide

interim order dated 14.09.2023, permitted the applicants to

provisionally appear in the selection process, subject to the final

outcome of the O.A., with a further direction that their result be

produced in a sealed cover.

3. In compliance thereof, the respondents have produced the

sealed cover result, which has been opened and perused by this

Tribunal.

4. On examination of the result, it is noticed that only one

candidate, namely Mr. Praveen Kumar Sharma, who appeared for

Post Code 66/23, has been shown as qualified. However, it is not

in dispute that the said candidate is over the prescribed age limit

as per the Recruitment Advertisement.

5. As regards the remaining applicants i.e. Anurag Kaushik,

Sandeep and Imran Teli, who appeared for Post Code 66/23, it is

evident from the result that they have not qualified in the

examination as per the criteria laid down in the Advertisement. In

particular, Ms. Jyoti, who appeared for Post Code 67/23, has not

secured the minimum qualifying marks in Se
