Roy, Counsel O R D E R In accordance with the order of the Hon’ble Chairman, Central Administrative Tribunal, dated 10.09.2021 issued under Sub -Section (6) of Section 5 of the Administrative Tribunals Act, 1985, this matter can be taken up by a Bench consisting of a single member. Accordingly, this matter is taken up for disposal by this Single Bench.
2. The applicant has filed this Original Application, seeking the following relief(s):
“i) An Order do issue directing the respondents to pay interest on delayed payment of family pension and also to pay interest on arrears of family pension.”
Facts of the case
3. The applicant is the daughter of late Dinendra Kumar Roy Government employee working under the Garrison Engineer (W), Military Engineer Services. Shri Dinendra Kumar Roy expired on 17th May, 1964 leaving behind his widow and two unmarried daughters namely Ms. Anita Roy and Ms. Samita Roy. After death of her husband, Smt. Hanshi Roy was in receipt of family pension. Smt. Hanshi Roy expired on 30th April, 2012.
4. After the death of her mother namely Smt. Hanshi Roy, the applicant had informed the Principal Controller of Defence Accounts, vide letter dated 3rd September, 2012 about the death of her mother and had submitted her claim for grant of family pension. Thereafter, she was asked to submit certain documents vide the said letter dated 11.10.2012 and she had submitted the same alongwith letter dated 22nd August, 2013 (Annexure A-6) addressed to the Garrison Engineer (West), Military Engineer Service, Bareilly.
5. The applicant made representations to the competent respondent authority seeking grant of family pension. However, since her request in this regard was not acceded to, she had filed an Original Application being O.A. No. 304 of 2021 which was disposed by this Tribunal dated 24.03.2021 (Annexure A-9) with direction upon the competent respondent authority to arrive at a firm decision on the prayer of the applicant in accordance with law.
6. The applicant was asked vide letter dated 20.07.2021 to attend the Office of Garrison Engineer (W), Military Engineering Service, Bareilly to sign certain documents. The applicant informed the said authority that during pandemic situation it was not possible for her to attend the Office of the respondents and requested them to send the documents by post.
7. The applicant was informed vide letter dated 30th November, 2021 that the service book of her late father was not available with the authority and that since she did not come to the office of the respondents for signing the pension documents as directed by them, her prayer for family pension could not be processed.
8. The applicant had thereafter filed an Original Application being O.A. No. 350/2020/2021 which was disposed of by this Tribunal, vide order dated 07.11.2022 (Annexure A-11) with direction upon the competent respondent authority to release the family pension admissible to the applicant at the earliest within 2 months without any further procrastination. Further, the Tribunal, vide the aforesaid order granted liberty to the applicant to make a representation before the concerned authority to seek interest on the delayed release of dues.
