ORDER

This OA has been filed by the applicant seeking the following relief:
“a) call for the records pertaining to the impugned displacement transfer order bearing F.11-E-11046/2/2025-ESTT-ii/Part-A-2-I-(A)
b )organizational requirements, dated 16.04.2025 st issued by the 1 respondent authority (A-5), the surplus transfer orders bearing No.F.No.13046/KVS/BangaloreRegion/PRV/202 4-2025/43-76, dated 01.04.2025, issued by the rd th
3 respondent in favour of the 6 respondent (A-3) and the impugned Memorandum bearing File No.11-E-II065(PGT)/19/2025-Estt-II/1648- 52,dated 09.10.2025 (A-13) quash the same as illegal so far as applicant is concerned and direct st the 1 respondent authority to re-transfer the th applicant to 5 respondent Vidyalaya and c) cost of this original application be paid by the respondents and d) pass such further or other order as may be required in facts and circumstances of the case”

Brief facts of the case, as submitted by the applicant are as follows: The Applicant joined the services of the Kendriya Vidyalaya Sangathan (KVS) on 16.10.1997 at Lalgargh Jattan in Jaipur Region, a hard station, as a Post Graduate Teacher (English) [PGT (English)] through Direct Recruitment. Upon completion of her tenure, she was transferred to KV No.1, Hubli on 04.10.2000. Thereafter, she was transferred to KV Meenambakkam on redeployment of surplus staff during her Less Than Three Years to Retire (LTR) tenure. The Applicant is due to retire on 30.04.2027. It is the specific case of the Applicant that she was deliberately rendered surplus by posting another surplus employee, namely the 6th respondent, who has more than ten years of service remaining before retirement to KV No.1, Hubli in her place. Consequently, the Applicant, despite falling under the LTR priority category, was displaced and transferred to KV Meenambakkam. Such action on the part of the authorities is arbitrary, discriminatory, and contrary to the KVS Transfer Policy. The Applicant submitted a representation, dated 14.04.2025 to the 1st respondent through the 5th respondent, seeking clarification as to whether she was treated as surplus or displaced, especially after the 6th respondent joined the 5th respondent Vidyalaya pursuant to the transfer order, dated 01.04.2025. However, no response was received. The Applicant also attempted to apply for a general transfer during the current session, but access was denied due to the impugned transfer order. As a result, the Applicant has been subjected to undue hardship and difficulty at the fag end of her career, compelling her to file OA No.690/2025 before this Tribunal which disposed of the said by an order dated 01.09.2025, directing the respondents to consider the Applicant’s detailed representation dated 23.05.2025 in accordance with law by passing a reasoned and speaking order. However, pursuant to the said direction, the respondents rejected the Applicant’s claim without addressing the grounds raised therein. Hence, the present Original Application has been filed challenging the impugned order.
