ORDER(Oral)

PER MR. RAJINDER SINGH DOGRA, MEMBER (J):

The applicant has moved this OA, seeking the

following reliefs:

“(i) An order or direction, directing the respondents to

accord promotions to the applicant against the post of

Sub Inspector from the date the applicant was entitled

with all consequential benefits.

(ii) An order or direction, directing the respondents to

consider the claim of the applicant, for promotion and

grant him grade attached to the post of Sub Inspector and

refer the case before the Accountant General for refixation

of the pension of the applicant.

(iii) An order or direction, directing the respondents to

grant promotion to the applicant from the date the juniors

to the applicant were promoted with regard to the

promotion for the year 2023 with all consequential

benefits.

(iv) Any other order which this Hon’ble Tribunal may

deem fit and proper may also be passed in favour of the

applicant and against the respondents.”

2. The brief facts of the case are that the applicant is

basically aggrieved of the inaction on the part of the

respondents, who have failed to consider the applicant

for promotion despite the fact that the applicant was

entitled for promotion against the post of Sub Inspector.

As the applicant was due for promotion in the year

2022, but the respondents have not considered the

applicant and his promotions were withheld. However

the promotions were considered in the month of

December 2022 in which the applicant was also

considered, but due to deficient marks in APR grading,

he was not granted promotion. That prior to two months

of the retirement of the applicant, the applicant moved

an application to the PHQ J&K through proper channel

for his promotion to the rank of Sub inspector. That in

the month of January 2023, service book of the

applicant was sought from PHQ and the applicant was

told that DPC for promotion will be held on 25.04.2024,

but unfortunately, same was not held due to the reason

best known to the respondents and ultimately, the

applicant superannuated on 30.04.2024. Therefore, the

applicant has been deprived of his right of promotion on

the pretext that the other batch mates who were even

juniors to the applicant have been considered for

promotion, which constrained the applicant to file a

detailed representation before the respondents from

time to time. However, the Representations dated

12.02.2024 & 17.05.2024 moved by the applicant

yielded no result. Hence, this OA.

3. Learned counsel for the applicant has fairly

submitted that it would suffice applicant’s purpose, if a

direction be given to the respondents to consider the

pending representations of the applicant within a

stipulated timeframe.

4. Learned counsel for the respondents has no

objection to such proposition.

5. Heard the parties.

6. In view of the above, respondents are hereby

directed to consider the pending representations dated

12.02.2024 and 17.05.2024 of the applicant by treating

the instant OA as a part of it and consider his case for

promotion to the post of Sub-Inspector and pass a
