1. The SWP/WP(C) No. 1533/2023 was transferred from the Hon’ble High Court of Jammu and Kashmir at Jammu and was registered as T.A. No. 61/244/2024 by the Registry of this Tribunal.

2. The present matter was filed before the Hon’ble High Court with following prayer:

a) “A. Certiorari quashing the impugned order no. AUJ/ Est./

G390-D-07/2023-24/2298-2324 dated 31/05/2023 passed by the respondent no. 2 whereby pre-final tentative seniority list of the Accounts Assistants appointed in the year 2003 and 2004 was notified after 17 years, despite the fact that already seniority list was prepared in the year 2006 and 2009 which has attained finality;

b) Certiorari quashing the impugned tentative seniority list of Accounts assistants of SKUAST Jammu notified in the year 2021 vide dated 30-06-2021 and no. AUJ/Est/G-390-D-

07/2021-22/1727-41 c) Mandamus directing the respondent no. 2 to keep the seniority list of petitioners as Accounts Assistants as being maintained in the year 2009 vide circular No. AUJ/Adm/09- 10/4943-50 Dated: 14-09-2009, which is being prepared keeping in view the conditions laid down in initial appointment order, in as much as, the promotion shall not be disturbed which is extended to the petitioners in the year 2012 as Accountants keeping in view the tenure of service and roster point as maintained by the University.

d) Any other writ / order / direction which this Hon'ble Court may in the given facts and circumstances of the case deem fit and proper may also be granted in favour of the petitioner.

3. The facts of the case as averred by the petitioners in their pleadings are as follows:

a) Respondent No.1 issued Notification No. 02 (Est.) of 2001 dated 04.06.2001, whereby candidates were selected for the post of Accounts Assistant in Sher-e-Kashmir University of Agricultural Sciences and Technology, Jammu (SKUAST-J). In the said selection list, the name of Petitioner No.1 figured at Serial No. 03 under the Scheduled Caste category.

b) Pursuant thereto, Petitioner No.1 was appointed as Accounts Assistant vide University Order No. 180 (Est.) of 2003 dated 07.11.2003. Subsequently, Respondent No.2, by Order No. AUJ/Adm/04-05 dated 21.05.2004, selected Petitioner No.2, who was a waiting-list candidate under the RBA category, for appointment to the post of Accounts Assistant.
