ORDER

Per: - Rajinder Singh Dogra, Judicial Member

1. The SWP No.2921/2017 was transferred from the Hon’ble High Court

of Jammu & Kashmir at Jammu and was registered as T.A

No.1583/2020 by the Registry of this Tribunal.

2. The present matter was filed before the Hon’ble High Court seeking

following relief: -

a) “Certiorari by quashing the impugned selection list for the post

Sericulture Assistant (Agriculture Production Department),

State cadre, Item No. 001 (01 of 2013, dated 16-02-2013

b) Mandamus by directing the respondent no. 1 to consider the

petitioner for the said post by drawing the merit of the eligible

candidates afresh.

c) Any additional and alternative relief may also be considered in

favour of the petitioner.

3. The facts of the case as pleaded by the petitioner in his pleadings are

as follows: -

a) The petitioner, Harjeet Singh, is a permanent resident of the

Union Territory of Jammu and Kashmir and a citizen of India,

entitled to all fundamental and statutory rights guaranteed under

the Constitution of India. The present Transfer Application

arises out of SWP No. 2921/2017, originally filed before the

Hon’ble High Court of Jammu and Kashmir at Jammu, which

stood transferred to this Tribunal and registered as TA No.

596/2022.

b) The Jammu and Kashmir Services Selection Board issued

Advertisement Notification No. 01 of 2013 dated 16.02.2013,

inviting applications for various posts in different Government

departments. Item No. 001 of the said advertisement pertained

to seven posts of Sericulture Assistant in the Agriculture

Production Department, State Cadre, with the category-wise

breakup being Open Merit–04, RBA–01, SC–01, and ST–01.

The essential qualification prescribed for the said post was

graduation in Natural Sciences (Medical) with Botany and

Zoology, along with a Post Graduate Diploma in Sericulture

(PGDS) from the Central Silk Board, Government of India.

c) The advertisement stipulated that applications were to be

submitted in OMR/ICR format between 05.03.2013 and

31.03.2013, accompanied by self-attested copies of requisite

qualification and category certificates. It was clearly notified

that incomplete applications were liable to rejection without

notice. Further, candidates were required to produce original

documents at the time of interview or whenever called upon by

the Board, failing which they would not be permitted to

participate in the selection process.

d) The petitioner asserts that he was fully eligible for the

advertised post and applied strictly in accordance with the terms

of the notification. He had completed his graduation from the

University of Jammu with Botany and Zoology in the year

2002, obtained an M.Sc. in Sericulture Technology in 2004

from the Central Sericulture Research and Training Institute,

Mysore (affiliated with the University of Mysore), and was

subsequently awarded
