1. The SWP No.1418/2018 was transferred from the Hon’ble High Court of Jammu & Kashmir at Jammu and was registered as T.A No.8561/2020 by the Registry of this Tribunal.

2. The present matter was filed before the Hon’ble High Court seeking following relief: -

a) “Writ of mandamus so as to command and direct the respondent to reframe the select list of health Educator by taking into consideration the fact that candidates selected in the Open merit category of health Educator at S. No. 1,2,4,5,6,7,9 and 11 have also been selected for other posts vide annexure -E by applying the notice dated 12.01.2018 (Annexure-C) in the interest of justice.

b) Further Writ of mandamus so as to command and direct the respondents to select and appoint the petitioner against the post of Health Educator advertised vide advertisement notice no. 05 of 2015 dated 01.09.2015 item no. 270 in the interest of justice.

AND Any other writ Order or direction which this Hon'ble Court deems fit and appropriate in the peculiar facts and circumstances of the case may also be issued in favour of the petitioner in the interest of justice.

3. The facts of the case as pleaded by the petitioner in his pleadings are as follows: -

a) The petitioner, Ankita Sharma, is a citizen of India and a permanent resident of the Union Territory of Jammu and Kashmir. She approached the Hon’ble High Court of Jammu & Kashmir (now transferred to this Tribunal) invoking its extraordinary writ jurisdiction for protection of her alleged legal and statutory rights arising out of a recruitment process conducted by the Jammu and Kashmir Services Selection Board (JKSSB).

b) The grievance of the petitioner arises from Advertisement Notification No. 05 of 2015 dated 01.09.2015, issued by the JKSSB, whereby a total of 1088 posts in different departments were advertised. Under Item No. 270 of the said notification, 18 posts of Health Educator were notified. The petitioner, claiming to possess the requisite qualifications and eligibility, applied for the said post and participated in the selection process.

c) It is pleaded that the petitioner appeared in the Combined Graduate Level (CGL) written examination conducted by the JKSSB in April/September 2017. The result of the written examination was declared in October 2017, pursuant to which the petitioner was shortlisted for interview, which commenced from November 2017 onwards. The petitioner’s name appeared in the shortlist at Serial No. 8, thereby confirming her participation in the final stage of selection.

d) Subsequently, the JKSSB issued a notice dated 12.01.2018 bearing No. SSB/Secy/Sel/2018/673-76, calling upon candidates who had been shortlisted and interviewed for more than one post under the CGL examination to submit their preferences. The stated object of the notice was to avoid repetition of candidates in multiple select lists, by ensuring that once a candidate is selected against his or her preferred post, such candidate would not be repeated for other posts, thereby enabling candidates lower in merit to be accommodated.
