Per: - Rajinder Singh Dogra, Judicial Member

a) The SWP No.592/2011 was transferred from the Hon’ble High Court

of Jammu & Kashmir at Jammu and was registered as T.A

No.6679/2020 by the Registry of this Tribunal.

b) The present matter was filed before the Hon’ble High Court seeking

following relief: -

a) Issue WRIT OF CERTIORARI quashing the selection and

appointments of private Respondents No. 5 to 22 as Constables

in Jammu and Kashmir Executive Police (District Jammu)

under "Actual Line of Control" Category, in pursuant to

Advertisement Notice: Pers-A-21/2010/14804-903 dated Notice

07.04.2010, having the same being suffering from illegality and

arbitrary exercise of powers of the Selection Committee, being

totally illegal, arbitrary. unconstitutional and in contravention

to the superior and better merit of the writ petitioner, especially

when the Official Respondents No. 1 to 4 have succeeded in

converting merit of writ petitioner into demerit;

b) Issue WRIT OF MANDAMUS directing and commanding the

Respondents No. 1 to 4 to consider the case of the writ

petitioner for selection appointment to the post of Constable in

Jammu and Kashmir Executive Police (District Jammu) under

"Actual Line of Control" Category and further release the
