O R D E R (ORAL)

01. The M.A. No. 731/2025 seeking permission to file a joint application under Rule 4(5)(a) of the Central Administrative Tribunal (Procedure) Rules, 1987 is allowed, as the applicants are found to have a common cause of action and are seeking identical reliefs.

02. The applicants have filed the present Original Application No.

570 of 2025 seeking following reliefs –

(i) An order, direction, seeking quashment of the rejection order No. 36 SHD of 2025 dated 15.5.2025 by virtue of which the claim of the applicants have been rejected.

(ii)Quash and set aside the Final Seniority Lists dated 21.5.2025, 24.5.2025 and 24.5.2025 for districts Budgam, Baramulla and Bandipora respectively.

(iii)Quash and set aside Circular No. DSHK/Estt/NF/2024- 25/14260-93 dated 15.3.2025 and Circular No. DSHK/Estt/NG/(170743)/471-503 dated 12.4.2025, being arbitrary, discriminatory and violative of SO 133 of 2022 and SO 151 of 2022.

(iv)Direct the respondents to prepare and notify a uniform seniority list of all Multi Tasking Staff (erstwhile Class IV employees) in strict conformity with SO 133 of 2022 and SO 151 of 2022.

(v)Direct the respondents to implement the SO 133 of

2022 and SO 151 of 2022 in its letter and spirit.

(vi)Restrain the respondents from conveing any Departmental Promotion Committee (DPC) or effecting any promotion on the basis of the impugned seniority list, pending finalization of a lawful and uniform seniority list.

(vii)Grant the petitioners the benefit of paritywith similarly situated employees in other departments and in terms of the judgment passed by the Hon’ble Tribunal, Jammu Bench, in a similar matter.

(viii)Pass any other writ, order or direction as this Hon’ble Court may deem just and proper in the facts and circumstances of the case.

03. The applicants have also prayed for interim relief of passing an ex-parte ad-interim order and stay the operation of impugned Order No. 36-SHD of 2025 dated 15.05.2025, impugned seniority lists dated 21.05.2025, 24.05.2025 and 24.05.2025, Circulars DSHK/Es
