ORDER (ORAL)

Hon’ble Mr. Manish Garg, Member (J)

By way of the present OA, the applicant seeks the

following relief:

“(a) Extend the same relief and benefits to the present Applicant

as granted to the applicants in Dalip Kumar and Ors. v. Union of

India & Anr., OA No. 3783/2024;

(b) Direct the respondents to apply 2% normalisation/relaxation

in the Skill Test scores of the present Applicant, arising out of the

Skill Tests conducted on 23..4.2024 and 24.04.2024 at iON

Digital Zone, Sarita Vihar, for all relevant vacancy years for

which the said Skill Test was conducted.

(c) Direct the respondents to prepare and issue revised

results/merit lists for all such vacancy years after applying the

aforesaid normalisation, and grant all consequential benefits,

including promotion, if found eligible;

(d) Award costs of the proceedings; or

(e) Any other relief which this Hon’ble Tribunal deems fit and

proper in favour of the applicant.”

2. Although we observe that no counter has been filed in the

OA, learned counsel for the respondents places on record an e-

mail communication dated 22.12.2025 which reads as under:

“Sir,

This is with reference to the subject mentioned above. The present

matter is similar to Dallip Kumar & Ors., which was disposed of

by the Hon’ble Central Administrative Tribunal on 02.09.2025,

wherein the Tribunal directed that the case be remanded to the

Chairman, SSC, with instructions to apply a 2% normalization

formula and issue a revised result with all consequential benefits.

Similar issues are also involved in Gaushe Alam & Ors, as well as

Akeel Ahmad & Ors.

In the matter of Dalip Kumar, the Commission has decided to

prefer an appeal by filing a Writ Petition before the Hon’ble High

Court of Delhi challenging the order dated 02.09.2025. The writ

petition is presently under drafting and shall be filed shortly.
