ORDER

PER MR. RAJINDER SINGH DOGRA, MEMBER (J):

The factual matrix of the case is that the petitioner who

is an outstanding sports personal and was in view thereof

appointed to the post of Sub-Inspector of Police vide Govt.

Order No. 358 of 1989 dated 15.04.1989. After rendering

around 22 years of regular and uninterrupted service as

Police Officer on different ranks, the respondents considered

the case of the petitioner for the promotion as Inspectors on

the basis of her seniority and merit and promoted her as

Inspectors and thereafter, as Deputy Superintendent of

Police. It is pertinent of mention here that after the

appointment of the petitioner as Sub-Inspector in J&K Police

under the Sports category, the Government in the Home

Department appointed one Shri Sanjiv Khajuria, S/o Late Sh.

Hari Krishan Khajuria as Sub-Inspector under the sports

category vide Order dated 30.12.1994. However, another

incumbent namely Sh. Dushyant Sharma, S/o Sh. Arjun Das

Sharma, was also considered by the Government in the Home

Department for his appointment and the said Sh. Dushyant

Sharma was appointed as Inspector in the J&K

Police(Executive Branch).

That Sh. Sanjiv Khajuria felt discrimination of the hands

of the Government in appointing him as Sub-Inspector and

Sh. Dushyant Sharma as Inspector, approached the Hon’ble

High Court by filing a Writ Petition bearing SWP No.

166/2000 titled “Sanjiv Kumar Vs. State of J&K & Ors.” The

said writ petition was considered by the Hon’ble High Court

and vide Judgement dated 22.12.2023, the same was allowed.

Thereafter, one LPA bearing No. 104/2005 filed by the State

Government before the Hon’ble High Court was also

dismissed vide Judgement dated 05.03.2009. In compliance

of the decision of the Hon’ble High Court, Office Order dated

06.07.2009 was issued by virtue of which the basis

appointment order of Sh. Sanjiv Khajuria as Sub-Inspector

has been modified and he had been appointed as Inspector of

Police(Executive) in the Police Department.

As per the applicant, she is similarly situated and

equally placed vis-à-vis Sri Dushyant Sharma and Sanjiv

Khajuria inasmuch as, she is also an outstanding sports

personnel and in view of her extra ordinary and meritorious

achievements in the field of sports, she is also entitled under

law to be given the same treatment as was extended by the

respondents first to Sri Dushyant Sharma in the year 1994

and later on to Shri Sanjiv Khajuria i.e. appointment as

Inspector in the J&K Police after the implementation of

directions passed by the Division Bench of Hon’ble High

Court. Hence, the present application has been moved by the

applicant seeking the following relief(s):

(a) Certiorari, seeking to quash Govt. Order No. 296-

(P) of 2014 dated 25.06.2014 passed by Respondent No.

1, whereby and whereunder, the case of the petitioner for

her appointment as Inspector instead of Sub-Inspector

under Sports Category w.e.f. 15.04.1989 i.e. date, when

the petitioner was appointed as Sub-Inspector in
