Rejection of the candidature of the applicant for the post of

Store Keeper-cum-Clerk under Economically Weaker Section

(EWS) category in AIIMS, Bhtou bdairneecstw tahre haaus thboeerinty c thoa lflielln guepd thbey

is qualified in the merit at Serial. No. 55 published on

30.07.2024 (Annexure-A/7) and also having experience for the

said post, by declaring the final result (Annexure-A/9) noted in

the column as “not eligible” and cancellation of the applicant’s

candidature is illegal and not sustainable in the eye of law,

which is based with no reason extracted in verbatim

2. Respondents-AIIMS filed counter in which it is stated that

the applicant, pursuant to the notification dated 01.07.2023, was

one of the candidates for the post of Store Keeper-cum-Clerk in

AIIMS, Bhubaneswar under the Economically Weaker Section

(EWS) category. In the advertisement, besides other posts,

RAVI KUMaApRplications were also invited for 85 posts of Store Keeper-cum-

Clerk, out of which 8 posts were reserved for EWS. The process

of selection was undertaken, as per rules, for all the vacancies in

various categories as advertised. Insofar as 85 posts of Store

Keeper-cum-Clerk is concerned, after the conclusion of process

of selection, 6 selected candidates under EWS category appeared

for document verification and 4 waitlisted EWS candidates,

including the present applicant whose name appeared Sl. No. 55

in the merit list, were also subjected to document verification.

During verification of documents, it was found that the

experience certificate submitted by the applicant was of a private

entity, i.e. Harianna Trading Co., where the applicant was alleged

to have worked as a Store-in-charge from June 2012 to June

2016 whereas the applicant submitted the essential qualification

of Graduation certificate, which he had obtained in 2020. In other

words, the experience certificate submitted by him before he

acquired the essential qualification of Graduation, as against the

specific condition stipulated in clause 1.4 of the Advertisement

making aware to the intending candidates that acquiring

experience must be after acquiring the prescribed educational

qualification of Graduation. Hence, his candidature for the post of

Store Keeper-cum-Clerk was rejected by the Document

Verification Committee. The applicant attempted to submit a new

experience certificate at a later stage, which he had not disclosed

in his application submitted within the due date pursuant to the

advertisement. Hence, the same was not accepted. It is stated

that after completion of the process of selection and document

verification, offer of appointment has already been issued in

favour of the eligible candidates belonging to the EWS
