ORDER Hon'ble Dr. Sumeet Jerath, Member (A):

Since both these OA Nos. 4424/2018 and 1522/2024 have a common question for adjudication hence both of them are decided by a common order. Facts of OA No. 4424/2018 being the leading case, are discussed below for better adjudication. The instant OA has been filed by the applicants under section 19 of the Administrative Tribunals Act, 1985 seeking the following reliefs:-

"a) to give promotion/notional promotion along with all consequential benefits of pay fixation, arrears of pay and allowance, to the applicants from 1st July, 2017.

b) to re-fix their pensionary benefits with arrears.

c) provide exemplary compensation may be imposed upon the Respondent for mental agony suffered by the Applicants d) Any other order, as may be deemed fit by the Hon'ble Tribunal.”

2. The factual matrix of the case as per the counsel of the applicants is that the applicants were appointed as Deputy Secretary in the selection grade of Central Secretariat Service (CSS) on regular basis in the year 2012 vide DoPT OM dated 06.06.2016. Later, in the year 2017 DoPT found the applicants eligible to the included in the list of Director and consequently circulated their names to the Ministries/Departments for obtaining vigilance status. According to the counsel the respondents ought to have prepared and published the select list on or before 1st July of the respective recruitment year. However, the respondents failed to prepare the Director’s Select List in time and this could be published only on 27.09.
