Heard Shri Ashish Srivastava, learned counsel for the applicant and Shri Ajay Kumar Rai, learned counsel for the official respondents.

2. The instant Original Application under Section 19 of the Central Administrative Tribunal Act, 1985 has been filed for the following reliefs:

I. To quash the impugned seniority list dated 05.02.2013 issued by the respondent- 2, inter se seniority list dated

14.10.2014 published by the respondent-1 and Notification dated 26.11.2014 published by respondent-1 for promotion from Group C to Group B in Traffic Department for the post of Assistant Operations Manager against 70 % Quota Vacancy for the year, 2010-13 II. This Hon’ble Tribunal may be pleased to direct the respondent No.3 to correct the seniority list dated 05.02.2013 of Section Controllers after allowing the applicants the seniority as Section Controller from 12.03.1986 (applicant-1), 25.03.1986 (applicant-2) and

03.06.1986 (applicant-3)

III. This Hon’ble Tribunal may be pleased to direct the respondent-1 to reorganize the inter se seniority list dated 14.10.2014 after rectification in seniority list dated

05.02.2013 of Section Controller in the Allahabad Division.

IV. This Hon’ble Tribunl may graciously be pleased to direct the respondents that after fixing the seniority of applicants as Section Controller from due date the applicants be promoted as Deputy Chief Controller immediately after two years and thereafter they may be promoted as Chief Controller from due date and accordingly their pay be carry out.

3. The brief facts as stated in the Original Application are that the applicants were initially appointed as Assistant Station Master at individual stations in pay scale of Rs. 1200-2040 under Allahabad PUNIT KUMAR MISHRA Division. In view of acute shortage of Section Controller at Tundla Head Quarter under the Allahabad Division, the respondent-3 issued orders for posting of the applicants’ as Section Controller on adhoc basis in 1985- 86. In compliance thereof, the applicants (1 & 2) assumed the charge of Section Controller on 12.03.1986 & 25.03.1986 on ad hoc basis and on the basis of the aforesaid adhoc promotion orders, the applicants continuously working without any interruption.

3.1 The respondents department in 1992, 1995 and 1997 held the selection for regular promotion for the post of Section Controller and the applicants were selected in the selection held in 1995. However, the selected panel was not made operative and finally after the selection from 1997, the applicants and all Section Controllers working on adhoc basis in the Tundla Headquarter of the Allahabad Division were regularly promoted.

3.2 Since, the applicants have already passed the selection of section controllers held in 1995, they approached the respondents to allow them seniority from the date of passing in the selection held in the year 1995. It
