Heard Shri Uma Shankar Singh, learned counsel for the applicant and Shri Krishna Kumar Ojha, learned counsel for the respondents.
2. The instant Original Application, under section 19 of the Administrative Tribunal Act, 1985, has been filed by the applicant, seeking following reliefs:
(1) That, the present application is being filed by the applicant praying therein that the Hon'ble Central Administrative Tribunal, Allahabad, may graciously be pleased SAHIL to quash the order dated 31.05.2021, passed by the Disciplinary Officer, Assistant Divisional Engineer, West/Mau, the order dated 14.07.2021 passed by the Appellate Authority, Divisional Engineer/General Varanasi, and the order dated 02.09.2021 passed by the Revisional Officer, Additional Divisional Rail Manager (Infra), Varanasi.
(2) Further the present application is being filed by the applicant for making the payment of the full salary as was being paid earlier with due increments and future salary on due dates with interest.
(3) Any other direction, writ or order which is deemed fit and proper in the interest of justice, may kindly be allowed also.
(4) Cost of the application may also be allowed.

The facts, as per the applicant, are that the applicant was initially appointed as a Soldier in the Defence Services on 16.12.1988 and after attaining the age of superannuation, he retired from service on 31.12.2012. Thereafter, the applicant, under the Military Quota, joined the Railway Department as a Track Maintainer on 01.04.2015 at Mau Junction and was discharging his duties satisfactorily. However, on 22.08.2019, a charge sheet was issued to him under sub sections I, II, III of Section 3.1 of the Railway Service Conduct Rules 1966, stating therein that the applicant has abused and assaulted his superior at his residence and later at Rasara Yard, affecting the railway work.
3.1 Thereafter, the applicant submitted his first clarification letter dated 09.09.2019 praying therein that the initial clarification may not be treated as final clarification and sought certain documents, which were not supplied to him. An enquiry was conducted on 14.09.2019 against the applicant. The applicant filed his defence on 10.06.2020. After completion of the enquiry, the enquiry report dated 17.05.2021 was supplied to the applicant. In response thereto, he submitted his defense on 27.05.2021. Thereafter, the Disciplinary Authority, by order dated 31.05.2021, imposed a major penalty of decreasing the minimum grade pay scale of Rs. 1800 for five years and further stating therein that the effect of penalty will continue on future increase in pay scale also.
3.2 Thereafter, the applicant filed an appeal dated 22.06.2021 before the Appellate Authority. The Appellate Authority vide its order dated 14.07.2021, reduced the penalty period to 35 months from five years and further ordered that the penalty would not affect future increase of pay after completion of the said period.
