ORDER

The applicant has filed this OA under Section 19 of the Administrative Tribunals Act, 1985 seeking the following reliefs:

“8.A) This Hon'ble Tribunal may graciously be pleased to call for the records of the case from the respondents and after examining the same issue directions for the sanction of full medical reimbursement claim and quash the impugned disallowance Order Passed by the Respondent no.1.

8.B) This Hon'ble Tribunal may further be pleased to direct to Respondent no. 1 to reimburse the balance amount along with interest @ 12% from the date when payment became due.

8.C) Costs of the application be provided for.

8.D) Any other and further order as this Hon'ble Tribunal deems fit in the nature and circumstances of the case be passed”

2. Facts of the case are that the applicant is an employee of Respondent No. 1, Ammunition Factory, Khadki. The applicant submitted a claim for advance medical reimbursement for the treatment of his father, Mr.

Maruti Tukaram Mane, who required surgery for brain hemorrhage. The CMO, Ordnance Factories Hospital, Khadki, issued a Referral Certificate as the facility for brain hemorrhage surgery was not available in their hospital. On 31st August, 2016, the HOD, Ammunition Factory, Khadki granted permission for outside treatment and sanctioned Rs. 34,000/- as advance medical reimbursement for treatment at Jehangir Hospital (a CGHS and CSMA-

recognized hospital).

2.2 The applicant admitted his father to Jehangir Hospital on 31st August, 2016. The RME Aid Fund Labour Office, Ammunition Factory, Khadki, Pune, issued an authority letter dated 3rd September, 2016 to Jehangir Hospital stating that the full hospital bill would be paid on behalf of Shri Jitendra Maruti Mane. After surgery, Jehangir Hospital discharged the patient on 13th September, 2016 and issued a total bill of Rs. 2,45,523/-.

2.3 Applicant submitted the full bill for reimbursement, but Respondent No. 2 sanctioned only Rs. 1,22,998/- including the advance amount of Rs. 34,000/-. The balance amount of Rs. 1,22,525/- was disallowed. Respondent No. 1 initiated recovery of the disallowed amount from the salary of the applicant.

2.4 The applicant submitted a representation on 24th July, 2017 to Respondent No. 2 (Accounts Office) requesting sanction of the remaining reimbursement of Rs. 1,22,525/-. By September 2019, Respondent No. 1 recovered a total of Rs. 1,23,583/- from the applicant’s salary towards the disallowed reimbursement. Hence, the present Original Application has been filed.

3. Respondents have filed their reply contending that all the units of Ordnance Factories were transferred to the newly formed seven DPSUs. Further, the management, control, operations and maintenance of the OFB were transferred to the Directorate of Ordnance (Coordination & Services) ("Directorate") with effect from 01st October, 2021. It is submitted that till 30th September, 2021, Respondent No.2 was the sole authority to process and pay the medical claims of the concerned employees. The medical expenses claimed by the Applicant were forwarded to Respondent No.2 by Respondent No.1.

3.2 It is submitted that consequent upon the transfer of Ordnance Factories to the DPSUs w.e.f. 01st October, 2021 and as per the decision of the Government of India, the office of Respondent No.2 wound
