ORDER (ORAL)

By way of the present OA filed under Section 19 of the AT Act, 1985, the applicant has prayed for the following relief(s):-

“(i) Direct the respondents to undertake the cadre re-structuring of the cadre of X-Ray Technician /Radiographers and the cadre review of the department may kindly be completed within three months to ensure proper re-structuring and parity.

(ii) Direct the respondents that the pay level of X-ray Technician may kindly be fixed at level-06 in the Cadre Review and revised Recruitment Rules, in order to rectify the existing dual pay anomalies and maintain uniformity across all similar as per the various pay commission recommendation.

(iii) To direct the respondents that the feeder cadre for the post of X-ray technician/Radiographer should commence from the post of Radiographer in consonance with 7th CPC recommendation (iv) To direct the respondents that qualification of B.Sc. in Radiography/ Imaging technology may kindly be included in the new Recruitment Rules and education standards as advised and advocated by NCAHP, keeping in the advancement of imaging modalities such as MRI, CT, DSA, Digital radiography, Interventional Radiography, DEXA, and Mammography etc. which require highly skilled and technically trained Radiographers for the safe and efficient operation, as well as improve patient care.

(v) To direct the respondents to follow the guidelines of DOPT OM No.I-1101/16/2022-CRD dated 30.09.2022 for cadre review. A structural ratio of 3: 1 between feeder grade and higher level may be maintained.

(vi) To award costs in favor of the applicants.

(vii) May also pass any further order(s), direction(s) as be deemed just and proper to meet the ends of justice.”

2. The applicants are aggrieved by the inaction of the respondents in not conducting cadre restructuring for the cadre of Radio-Diagnosis/ X-

Ray cadre.

3. Learned counsel for the applicants submits that since the inception of the cadre in the year 1981, the respondents have not undertaken any cadre restructuring of the said cadre, despite several representations made by the applicants, including Annexure A-9.

4. Learned counsel further submits that respondent No. 2 has not forwarded a copy of the said representation to the remaining respondents, though a copy of the same was also endorsed to the remaining respondents.
