ORDER Per: - Rajinder Singh Dogra, Judicial Member

1. The SWP No.762/2018 was transferred from the Hon’ble High Court of Jammu & Kashmir at Jammu and was registered as T.A No.6578/2021 by the Registry of this Tribunal.

2. The present matter was filed before the Hon’ble High Court seeking following relief: -

a) “Certiorari, quashing the selection of respondents Nos. 6 to 18 against the post of Constable in IRP pursuant to advertisement notice No. Pers-A-38/2016/59220-320 dated 08.10.2016 under OSC category;

b) Mandamus, commanding the respondents to include the name of the petitioner in the select list post of Constable in IRP pursuant to advertisement notice No. Pers-A-38/2016/59220- 320 dated 08.10.2016 at serial No. 3 under OSC category in view of his merit;

c) Mandamus, commanding the respondents to consequently appoint the petitioner against one of the post of Constable IRP advertised vide advertisement notice No. Pers-A-

38/2016/59220-320 dated 08.10.2016 under OSC category;

d) Any other writ, order or direction which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case, may also be granted in favour of the petitioner and against the respondents along with cost.”

3. The facts of the case as pleaded by the petitioner in his pleadings are as follows: -

a) The applicant, a permanent resident of District Jammu belonging to the OSC category, applied for the post of Constable in J&K Police pursuant to Advertisement Notice dated 08.10.2016, which invited online applications district- wise for IRP/Armed/Executive Police. He possessed the requisite educational qualification and opted for IRP as his first preference. According to him, when he submitted the online form on 18.11.2016—two days before closing— the website was overloaded, the drop-boxes were not responding, and although he selected OSC c
