By way of the present O.A. filed under Section 19 of the Administrative Tribunals Act, 1985, the applicant has prayed for the following reliefs: -

“a) Quash and set aside the impugned orders to the extent that the Applicant's resignation has been treated as non- technical and direct the Applicant's resignation as Technical Resignation.

(b) Direct the respondents to grant the applicant all the benefits of technical resignation, including treatment her service as continuous for eligibility, fixation of pay, residency service for purposes of posting etc.

(c)Any other relief which this Hon'ble Tribunal may be pleased to issue.”

FACTS OF THE CASE

2. The applicant was appointed as a Primary Teacher (PRT) under Kendriya Vidyalaya Sangathan in Kendriya Vidyala No.1 Kunjaban, Agartala on the basis of Kendriya Vidyala's North Eastern Special Recruitment 2018 on 02.07.2018. She had applied under North Eastern Special Recruitment and was selected and appointed in the above school under North Eastern Zone, under Silchar Region.

2.1 As the applicant’s posting was on the basis of the Special Recruitment for North Eastern Zone was restricted to Kendriya Vidyalaya Schools under the North Eastern Zone, the Applicant applied for the same post of Primary Teacher under Kendriya Vidyalaya Sangathan Recruitment Examination 2022, which was for posting in KVS Schools all over India.

2.2 The applicant sought permission for appearing in the examination from her home town, i.e Hissar, Haryana, vide her letter dated 06.02.2023 and she was also permitted by the Principal for the same as per KVS norms.

2.3 Based on her performance in the computer based test held in February 2023, she was called for interview on 04.11.2023 vide letter dated 31.10.2023.Having qualified in the KVS Recruitment Examination 2022, Kendriya Vidyalaya Sangathan, Regional Officer, Guwahati issued an offer of appointment letter dated 30.11.2023, posting her in Kendriya Vidyalaya, Rangapara in Guwahati Region.

2.4 The applicant submitted her application seeking her relieving from KVS No.1 Kunjaban, Agartala where she was then teaching for her joining. The said application was forwarded by the Principal to the Deputy Commissioner, KVS, Regional Office, Silchar vide his letter dated 04.12.2023. Subsequently, the applicant submitted her letter through proper channel dated 06.12.2023, addressed to the Deputy Commissioner, requesting for accepting her Technical Resignation and also requesting for waiving of prior intimation.

2.5 Thereafter, the Deputy Commissioner, Kendriya Vidyalaya Sangathan, Regional Office, Silchar vide letter dated 07.12.2023 intimated the Principal, Kendriya Vidyalaya, Kunjaban, Agarthala that her request for technical resignation has not been acceded to. However, her resignation from the present post was accepted. Due to paucity of time, the applicant submitted resignation letter and reported for duty in the new Kendriya Vidyalala on 11.12.2023. Applicant was taken on strength of the new Kendriya Vidyalaya from that date.
