ORDER (ORAL)

By way of the present O.A. the applicants seek following reliefs:-
“8. (i) Set aside the impugned Order No. F.397 /DDE(IEB)/Court Case/2022-23/665-76 dated 24.05.2022 passed by the Directorate of Education, whereby the request of the applicants herein pertaining to relaxation of CTET qualification for appointment on the post of Special Education Teacher (Post Code 146/14) in DOE was rejected;
(ii) Set aside the impugned Rejection Notice No. 436 dated 03.02.2016, whereby the candidature of the applicant for appointment on the post of Special Education Teacher (Post Code 146/14) in DOE was rejected on the ground that the applicant had cleared CTET qualification after 27.02.2014 i.e., stipulated closing date for submitting the application form;
(iii) direct the respondents to relax CTET qualification for the applicants for appointment on the post of Special Education Teacher (Post Code 146/14) in DOE and accordingly, consider the candidature of the applicant for appointment on the post of Special Education Teacher (Post Code 146/14) in DOE without insisting on the condition that the applicants ought to have possessed CTET qualification on/ or before the cut off date i.e. 27.02.2014;
(iv) direct the respondents to appoint the applicants for appointment on the post of Special Education Teacher (Post Code 146/14) in DOE and grant them all the consequential benefits (monetary as well as non- monetary) thereof including seniority, back wages, etc; (v) allow the present Original Application with costs in favour of the applicant;
(vi) issue any other appropriate order or direction as this Hon'ble Tribunal may deem fit and proper in the
SHILPI GUPTA interest of justice and in the favour of the applicant.”
2. Highlighting the facts of the present case, learned
counsel appearing on behalf of the applicants would
submits that the applicants have applied for the post of Special Education Teacher (Post Code 146/14) in Directorate of Education pursuant to the Advertisement No. 01/2014 dated 27.01.2014 issued by the Delhi Subordinate Services Selection Board (DSSSB). The cut- off date was 27.02.2014 and the applicants have obtained the qualification of CTET on 09.10.2014.
