3. The brief facts of the case are that the The applicant was initially appointed to the post of Assistant/Superintendent on 06.03.1980 in the Office of the Development Commissioner (Handicrafts) at Agra, which functioned under the administrative control of the Ministry of Textiles and was later transferred to the Ministry of Statistics and Programme Implementation. He joined service in the pay scale of Rs. 470-750 and rendered continuous, satisfactory, and unblemished service until his superannuation. Notably, the applicant did not receive any regular promotion throughout his entire service career. To address the issue of stagnation faced by employees due to lack of regular promotions, the Government of India formulated the Assured Career Progression (ACP) Scheme and its successor, the Modified Assured Career Progression (MACP) Scheme. These schemes are designed to provide financial upgradation upon completion of 12, 24, and 30 years of service without a regular promotion, thereby offering relief from career stagnation. In the applicant's case, he completed 24 years of regular and satisfactory service on 06.03.2004, thereby becoming eligible for the 2nd financial upgradation under the ACP Scheme. However, the official order granting this 2nd ACP was issued belatedly on 28.03.2014, a full decade after his entitlement and after his retirement from service. Subsequently, upon completion of 30 years of regular service on 06.03.2010, the applicant became eligible for the 3rd financial upgradation under the MACP Scheme. While an order was issued granting this 3rd MACP with effect from 06.03.2
