The application having been heard on 31.10.2025, the Tribunal on

12.12.2025 delivered the following order:

O R D E R

Justice K.Haripal, Judicial Member The question posed for consideration in this Original Application is whether the past Military service rendered by the applicant during the period between 27.10.1977 and 23.10.1982 can be added to the civil service performed by him on re-employment in the Doordarsan Kendra.

2. The facts of the case are that the applicant was enrolled as a Sepoy in the Army on 27.10.1977 and was got discharged on 23.10.1982 on his own request. Thereafter, he was re-employed in the All India Radio on 10.11.1986 as Security Guard. After the bifurcation of the All India Radio as AIR and Doordarsan, he was posted in Doordarsan and continued as Security Guard. Thereafter he retired from service on superannuation on 30.09.2017. The grievance of the applicant is that even though he had rendered 4 years 11 months and 25 days service as a Sepoy in the Army, that was not credited to his latter service so that he has not been granted benefits of the same. Though he made numerous representations, that were not considered. At last, by Annexure-A1 order dated 06.02.2017, the 3^rd respondent rejected his plea as he had resigned from the Military service on his own, consequent to which, he is not entitled to get Military pension and service gratuity.

Therefore, his Military service was not counted with his present civil service.

According to the applicant, such a decision was taken by the respondents in an arbitrary and discriminatory manner, without application of mind and not based on relevant considerations or relevant materials, which is violative of the Constitutional guarantees enshrined in Articles 14 and 16 of the Constitution.

4. It is also submitted that similarly placed employees were granted benefits. He has cited two instances through Annexures-A3 and A4 and submits that one Joseph James, who had put in only 3 years 11 months and 14 days in Military service, which was added up to his credit. Similarly, he has highlighted the case of one Raveendran Nair, who is also a Security Guard in Doordarsan Kendra, who had rendered service from 10.03.1979 to 03.07.1984, which was added to the credit of the said Security Guard. But when the case of the applicant was taken up, similar treatment was not given to him, so that he complains that he has been discriminated against.

Thus the applicant seeks to quash Annexure-A1 rejecting his plea for adding the Military service to his credit and to direct the respondents to issue appropriate orders extending the benefit of the Military service with civil service in All India Radio and Doordarsan Kendra, with all consequential benefits as granted to similarly placed colleagues mentioned in the O.A.

6. The respondents have denied the claims of the applicant.
