O R D E R Per:- Rajinder Singh Dogra, Judicial Member The applicant had filed SWP No. 2615 of 2017 before the Hon’ble High Court of Jammu & Kashmir seeking the following the reliefs:-

“It is, therefore, respectfully prayed that writ petition may kindly be accepted by issuing an appropriate writ, direction or order including in the nature of writ of certiorari quashing the communication No. Esstt/1077-C/3905-07 dated 8-9-2017 in so far as and to the extent it pertains to the petitioners whereby their claim for regularization has been rejected on factually incorrect and misconceived ground that they were over aged at the time of their initial appointment With A further writ of mandamus commanding the respondents;

(i) To regularize the petitioners on permanent basis as warders with effect from 28.04.2010 when the J&K Civil

interest @ 15% p.a.

(ii) To sanction and pay the full pay scale of the warder with effect from 1-2-2001 with arrears and interest @ 12%

p.a.”

2. After the reorganization of State of Jammu and Kashmir into Union Territory of Jammu & Kashmir and Ladakh and in view of the Notification No. G.S.R. 267 (E) dated 29.04.2020 read with notification No. G.S.R. 317 (E) dated 28.05.2020 issued by the Ministry of Personnel, Public Grievances and Pensions (Department of Personnel and Training), the jurisdiction to adjudicate upon the lis regarding service disputes of the employees of UT of J&K and Ladakh was conferred upon this Tribunal and while considering the said fact, the record of Service Writ Petition No. 2615 of 2017 was ordered to be transferred by the Hon’ble High Court to this Tribunal on 19.08.2020 and renumbered as Transferred Application (in short T.A.) No. 4466 of

2020.

3. The brief facts of the case, as stated in the T.A. are that It is further stated that Applicant No. 1 was appointed as Sepoy in the Army on 24-3-1979, promoted to Naik rank, served 16 years and 7 days, and was discharged with pensionary benefits. His date of birth is 12-5-1961. Similarly, applicant No. 2 was appointed as Sepoy in 1979, promoted to Naik rank, served 18 years and 13 days, and was discharged with pensionary benefits on 30-11-1997. His date of birth is 29-1-1962. It is stated that respondent No. 4 issued advertisement notice No. DIP/J-2483 dated 19-1-2001 inviting applications for

pursuant to the advertisement and appeared for interview on 27-1- 2001 They were selected by the Selection Committee headed by the Superintendent District Jail, Poonch. Thereafter, Respondent No. 2 issued order No. 76 of 2001 dated 1-2-2001 appointing them as Jail warders on consolida
