This Original Application has been filed under Section 19 of the Administrative Tribunal’s Act. 1985 to claim the following reliefs:

“1. The applicant respectfully prays that this Hon'ble Tribunal may be pleased to call for the records pertaining to order File No. GCCO/II/39/OTH/34/2024-ESTT-O/o Pr. CC- CGST-Zone-Bengaluru dated 23.12.2024 at Annexure A-1 passed by the Respondent NO. 3, rejecting the request of the applicant for arrears of pay scale to Rs. 5500-9000 w.e.f. 11.02.2003 and set aside the same after declaring the same as arbitrary, illegal and unjust;

2. Consequently, direct the respondents to grant the applicant upgraded pay scale of Rs. 5500-9000 in the post of Junior Hindi Translator w.e.f. 01.01.1996 notionally and actual payment

11.02.2003 instead of 17-03-2015;

3. Pay the applicant all arrears, of pay and other allowances. Consequently, re-fix the pay of the applicant as per VI CPC and VII CPC and pay her all arrears and other consequential benefits along with interest at GPF rate;

4. Order costs in the interest of justice; and

5. Pass such other order or orders as this Hon'ble Tribunal may deem fit and proper in the interest of justice.”

2. The reliefs are claimed based on the grounds mentioned in paragraphs 5(1) to (5) of the Original Application, which reads as follows:

“5.1 It is submitted that the Vth CPC had recommended common pay scales for all Hindi Officers working in C.S.O.L.S and other attached/ subordinate offices; the same was accepted by the government also. The government has upgraded the pay scales of Assistant Director/ Senior Hindi Translator/ Junior Hindi Translator by O.M. dt. 14- 07-2003. The same is applicable to the case of the applicant also as she is also similarly situated person.

5.2 It is further submitted that in pursuance of the orders of the Hon'ble Tribunal, Calcutta Bench in O.A. 912/2004 dated 09-11-2006 filed by Dhananjay Singh Vs. U.O.I and O.A. 402/2006 dated 17-10-2008 in the case of Sumanlata Bhatia VS UOI passed by Hon'ble C.A.T. Principal Bench, New Delhi, which were upheld by High courts and Hon'ble Supreme Court, the applicant is also eligible and entitled for the same relief. As such there is no grounds for the respondent authorities to deny the said benefit to the applicant. It is submitted that the Board vide letter F.No. A-23011/31/2015- Ad.IIA dated 30.08.2018 informed that the case of Dhanajay Singh was examined in Board in consultation with the Department of Expenditure (DOE) and DOE agreed to implement the live orders of the CAT/Court which are due for implementation in the case of applicants/petitioners. Board also informed that the DOE has not revised its policy and only agreed to implement CAT/Court orders. Hence, there is no change in the policy and therefore there is no case of extending the benefits of DoE OM dated 14.07.2003 to Jr/Sr Hindi Translators of field formations.
