By Ms. Mallika Arya, AM The applicant was appointed as Junior Telecom Officer (JTO) on 05.01.1998. The respondent authorities introduced a Time Bound Promotion for JTO to the grade of SDE (Telecom) in BSNL against 67% seniority-cum-fitness quota. The applicant was eligible and got promoted on 30.03.2011 (Annexure A-1). A copy of the gradation list for the aforesaid promotion in which the name of the applicant is mentioned at Sl. No. 969 is annexed as Annexure A-2. The applicant senior to respondent Nos. 4 and 5 as their names are mentioned at Sl. No. 1022 and 1168 in the gradation list. After receiving the promotion the applicant was relieved from his parent unit office i.e. DGM, EMP Area, WTP, Jabalpur to join in the office of CGM, BRBRAITT, Jabalpur as SDE (Telecom) on 30.04.2011. The applicant joined the office of the CGM, BRBRAITT, Jabalpur on 30.04.2011 in the afternoon. A copy of the relieving and the joining report are annexed as Annexure A-3 and A-4. A letter dated 06.05.2011(Annexure A-5) was issued by the BSNL, Corporate office to all Heads of the BSNL Circles with regard to the promotions PIYUSH CHANDRA

2025.12.12 of JTOs (supra). It was mentioned in the letter that since the case

challenging the aforesaid promotions is pending before CAT,

Chennai Bench and the CAT, Chennai Bench had directed to

maintain status-quo in respect of the promotional posts therefore,

further promotion to the said post be kept in abeyance till the pendency of the matter. Hence, in light of the order of CAT, Chennai Bench, promotion granted to the applicant could not be given effect. The employees who were granted promotion prior to issuance of order of CAT Chennai Bench have been granted the promotion to the post of SDE and could not be reverted back to JTO. Therefore the promotion granted to the applicant was not given to him and he kept working on the post of JTO till 17.04.2013. The applicant is working as JTO BRBRAITT Jabalpur. A copy of the order dated 26.05.2011 is marked as Annexure A-6. Later on the applicant learnt that the matter had been dismissed by CAT Chennai Bench. Hence the applicant has been deprived of his promotion to the post of SDE (Technical) w.e.f. 30.04.2011 without any fault of his. The applicant made a detailed representation dated 25.02.2013 (Annexure A-7) to Respondent No. 2 on the plea that all employees who were promoted alongwith the applicant have been given promotion as SDE (T). The applicant joined BRBRAITT (Respondent No. 3) on 30.04.2011 and the promotion order in his case could not be given effect in light of the stay given by CA
