O R D E R An Original Application (in short O.A.) has been filed by the applicant under Section 19 of the Administrative Tribunals Act, 1985 seeking the following relief:-
(i) quashment of posting order No. MES/40/2025/E1B (P&T-II) dated 31 Oct. 2025 issued by DG (Pers.), E-in-C’s Branch, whereby the applicant has been posted to HQ CE Jalandhar Zone, as it is arbitrary, illegal, passed with non-application of mind, violates the Posting Policy Guidelines dated 09 Oct. 2015, and contravenes Article 14 of the Constitution of India.
(ii) seeking direction upon the Respondents to consider the applicant’s case for Last Leg Posting to Amritsar (his home station) as per Policy Para 12(b) (v) of the Posting Policy Guidelines dated 09 Oct 2015, given his eligibility, the availability of vacancies in GE Amritsar, and his compelling family circumstances. Alternatively, direction to issue Last leg Posting to Amritsar with effect from 01 Mar 2026 (subsequent to retirement of Sh. Malkit Singh on 28 Feb 2026) or such other date as vacancies become available, in the interim allowing the applicant to continue at his current station GE (North) Akhnoor.
(iii) seeking direction to the Respondents to allow the applicant to continue in his current posting at GE (North) Akhnoor (or at such other station as he may request on staff posting) pending finalization and issuance of Last Leg Posting order to Amritsar, to prevent undue hardship and family disruption during the final year of his service.

It is submitted by the learned counsel for the applicant that impugned posting order dated 31.10.2025 issued by Engineer-in- Chief’s Branch, whereby the applicant, who is an Assistant Engineer (Civil), has been posted from GE (North) Akhnoor to HQ CE Jalandhar Zone, is in violation of the Posting Policy Guidelines dated 09.10.2015 of Ministry of Defence, as the applicant is scheduled to superannuate in April 2027 and as per transfer/posting policy dated Oct. 2015, an individual having less than three years of remaining service shall be considered for staff appointments at place of choice or near home town to help in taking care of family/settlement problems.

It is further submitted by the learned counsel for the applicant that applicant would be satisfied, at this stage, if a direction is issued to respondents to treat a copy of this O.A. as his representation and decide the case of the applicant by passing a reasoned and speaking order within a time frame and till such time, the applicant may be protected.
4. Mr. Raghu Mehta, learned Sr. C.G.S.C. appearing for Respondents vehemently opposed the contentions raised by the learned counsel for the applicant.

Accordingly, in view of the limited prayer made by learned counsel for the applicant, the Original Application is disposed of at the admission stage, without entering into the merits of the case, with a direction to respondents to treat a copy of this Original Application as representation of the applicant and decide the case of the applicant by passing a reasoned and speaking order. A copy of the speaking order shall also be communicated to the applicant.
