O R D E R

Per Kumar Rajesh Chandra, A.M.:- This OA has been filed by the applicant seeking the following relief:-

“(i) That This Hon’ble Tribunal be pleased to direct the respondents to disclose the guidelines for awarding merit points on each count and also the merit points granted on each count to the applicant vis-a-vis finally recommended candidates.

(ii) That The Hon’ble tribunal may quash the order as contained in file no. 186/A-12011/Comp Genl./Estt-III/ER/2020 dated 31.03.2022 issued under the authority of Administrative officer, Establishment-III Section for Additional Director & HOD (Additional Charge), GSI, ER, Kolkata informing the applicant that his case was considered for the period 01.01.2019-31.12.2019 and the applicant having secured less merit point than that of recommended candidate the applicant was not recommended and in terms of CAC guidelines, the reasonable number of times for consideration of appointment on compassionate ground in GSI is 5(Five) times, since the request for appointment on compassionate ground has been considered for 05 (five ) times till now, the office will not be able to consider your application further for appointment on compassionate ground according to aforesaid guidelines.

(iii) That the Hon’ble Tribunal be pleased to direct the respondents concerned to appoint the applicant on compassionate ground.

(iv) That this Hon’ble Tribunal be also pleased to grant any other relief or reliefs which may deem fit and proper in the facts and circumstances of this case including costs.

2. The brief facts of the case, as per the applicant, are as follows:-

(i) The father of the applicant was appointed as Messenger on 01.04.1976 and confirmed in service w.e.f. 02.05.1995. During the period of service, the father of applicant died on 11.12.2013 due to heart attack at Patna. He was survived by his mother, wife, minor son and a daughter who were all dependent upon the deceased employee.

(iii) Applicant has enclosed a letter dated 06.05.2014 ( Annexure- 4)whereby the representation of mother of applicant was forwarded to Dy. Director General, Geological Survey of India, Bihar, Patna and Dy. Director General & HOD, Geological Survey of
