ORDER (ORAL)

Hon’ble Mr. Manish Garg, Member (J):-

In the present Original Application, filed under Section 19 of the Administrative Tribunals Act, 1985, the applicant has prayed for the following relief(s):

“a) declare the applicant as pass in the typing test held on 8.03.2017;

b) issue a direction to the respondent No.1 to issue call letter to the applicant to enable him to verify the documents and appointment thereto, c) to pass any such order or further orders as this Hon'ble Tribunal may deem fit and proper.”

2. Highlighting the facts of the case, the learned counsel for the applicant submits that the applicant is an OBC candidate. He applied for the Combined Higher Secondary Level Examination, 2015 conducted by the respondents. He submits that the applicant appeared in all levels of the examination. However, the applicant’s candidature was rejected on the ground that he failed to qualify the skill test in the present matter. Strong reference and reliance have also been placed on the averments made in the counter affidavit. He further draws attention to the evaluation of the Type/DEST scripts (English/Hindi)

(Annexure A-5), which reads as under:

“ EVALUATION OF TYPE/DEST SCRIPTS (ENGLISH/HINDI)

NATURE OF MISTAKES A. Full Mistakes: The following errors are treated as full mistakes:

- For every omission of word/ figure.

- For every substitution of a wrong word/figure.

- For every addition of a word/figure not found in the passage.

B. Half Mistakes: The following errors are treated as half mistakes:--

(i) Spacing Errors: Where no space is provided between two words, e.g. 'lhope' or undesired space is provided between the words or letters of a word e.g. hope I have, 'I hxxave'.

(ii) For every spelling error committed by way of repetition, or addition or transposition or omission or substitution of a letter/letters, e.g. the word 'spelling' typed as 'seeplings' etc.

(iii) Wrong Capitalisation: Wrong use of capital letter for small letter and vice-versa. (This does not apply to Hindi typewriting scripts).

NOTE-1: Any corrections made by pen or pencil are ignored and no credit is given to such corrections.”

3. It is not in dispute that no specific prayer has been made on behalf of the applicant with respect to the revaluation or rechecking of the skill test. The learned counsel for the applicant further submits that the skill test was evaluated electronically. During the course of arguments, a specific query was raised as to whether any representation had been made to the respondents, prior to the filing of the present O.A., alleging that the percentage arrived at by the respondents in the skill test was more than 19%. The learned counsel for the applicant fairly submits that no such representation was made on behalf of the applicant.

Learned counsel for the respondents relies upon the averments made in the additional affidavit filed on behalf of the respondents, stating that the applicant appeared in Tier-I of the Combined Higher Secondary Level (10+2) Examination, 2015, wherein he scored 133.50 marks. On the basis of his performance in the Tier-I Examination, he was shortlisted for the Tier-II (Descriptive Type Paper) Examination and secured 62 marks in Tier-II. Accordingly, he was issued an admit card by SSC (NR) to appear on 08.03.2017 (Batch-III), and he then appeared in
