O R D E R (ORAL)

By Hon’ble Mr. Rajveer Singh Verma, Member (J):-

The applicants have filed the instant OA under Section 19 of the Administrative Tribunals Act, 1985, seeking the following relief(s) :-

“a) direct the respondents to make Basic salary, allowances and other applicable pay equal to the permanent Nursing Staff working in the respondent no.3/ Hospital, without making any delay and discrimination;

b) direct the respondents to pay 18% interest per annum on the payment of arrears from the date of representation till the date of decision in the present OA;

c) produce the relevant official record of the case;

d) pass such other and further order as this Hon'ble Tribunal may deem fit and proper in the interest of justice.”

2. The brief facts of the case are that the applicants are working as Nursing Staff under the respondent No.3 i.e. RML Hospital, on contractual basis since 28.11.2015. The services of the applicants were extended from time to time after revision of performances.

3. Learned counsel for the applicants submitted

that the job responsibilities and nature of work of

the applicants are the same as compared to the regular employees. However, the applicants are not being granted the regular pay scale at par with regular incumbents. It is submitted that similar benefit of same scale and allowances has already been granted in various organisations including Govt. of NCT of Delhi on the principle of „equal pay for equal work‟. Learned counsel for the applicants further submitted that the said principle has been upheld by the Apex Court with respect to the temporary employees vis-a-vis permanent employees in the matter of State of Punjab and Ors.
