Shri A K Srivastava, learned counsel for the applicant and Shri K K Ojha, learned counsel for the respondents, were present at the time of hearing.

2. The instant original application has been filed by the applicant seeking following relief:

“(i) By means of writ of certiorari quash the impugned order dated 25.08.2015 (contained as Annexure No A-1 to Compilation No I)

(ii) Issue an order or direction commanding the respondent to allow the applicant to join to the post of Group D for which he is being selected through all process in which the applicant was successful.

(iii) Issue any other suitable writ, order or direction as this Hon’ble Tribunal may deem fit and proper under the facts and circumstances of the case.

(iv) to award the costs of the application in favour of the applicant.”

The instant original application has been filed by the applicant challenging the order dated 25.08.2015 passed by the respondents by way of which the applicant has been debarred from all RRC /RRB examination for appointment in Railways for life time. By way of this OA, the applicant has sought quashing of the aforesaid order alleging that the order is illegal and arbitrary.

4. We have heard learned counsel for the parties and perused the records.

5. Learned counsel for the applicant submitted that the applicant had applied for the appointment in Group ‘D’ services in reference to the advertisement notified under Employment No 01/2010. He appeared in the written examination at Allahabad on 24.06.2012 from 09:30 Am to 11:30AM through attendance slip in which his roll no was 611208556. It was argued that owning to his illegal work, the respondent no 2 issued another letter to the applicant for appearing in the written test from 02:30 pm to 04:30 pm with different roll no 622207041 with different control no and examination centre. After qualifying the written test, the applicant was given an attendance slip by the respondent no 3 for appearance for race (daur) at Jhansi on 05.11.2012 in Jhansi. This fact was further confirmed from internet. The applicant appeared in the same and was declared qualified to the extent that the respondents stamped his qualification on the attendance slip. The respondent no 3 issued another attendance slip for document verification on 01.02.2013 at 09:30 hrs with the same roll no and in that also, the applicant was found fit. Subsequently, the applicant was sent for physical fitness before Senior Divisional Medical Officer at Divisional Railway Hospital at Jhansi where the applicant was found fit Aye Two under without glass category on 07.02.2013. After declaring the applicant fit in the physical fitness test by the Divisional Medical Officer, Railway Hospital Jhansi on 07.02.2013, the respondent no 2 after a gap of 1 year 34 days issued a letter that the applicant has to report to RRC, Allahabad for further document verification on 01.04.2014. The applicant submitted an application dated 11.12.2014 through RTI seeking result to which he was informed by the respondents that result would be declared very soon. Respondent no 2 sent Show Cause Notice through Memorandum dated 22.0
