1. Present original application has been filed by the applicant under Section 19 of the Administrative Tribunals Act, 1985, seeking following relief:-

(i) That impugned order dated 19-09-2019 (Annexure A-8) may please be set aside and quashed and respondents may please be directed to grant the benefit of counting of the previous service rendered on a contract basis from 08-12-2004 to 26-02-

2007 with all the consequential benefits.

ii) That arrears so accrued may please be ordered to be disbursed to the applicant with interest @ 12.00% from the date of accrual to the actual date of payment.

2. Briefly stated facts of the case are that one post of Assistant Professor (now re-designated as Associate Professor) in Sculpture was advertised by Department of Technical Education, Chandigarh on contract basis for Govt. College of Art (GCA), Sector 10, Chandigarh. Being eligible and qualified, the applicant applied for the post through proper channel and got selected by duly constituted Selection Committee and was offered the said post vide letter dated 02-12-2004 (Annexure A-1). On being relieved from Government Model Senior Secondary School, Sector 19-C, Chandigarh vide Office Order dated 08-12-2004 (Annexure A- 2), applicant joined duty in Government College of Art on the same day.

Being eligible and qualified, the applicant applied for the same and got selected. On the recommendations of UPSC, the applicant was appointed as Assistant Professor (Lecturer) vide offer letter dated 15.02.2007 (Annexure A-3), pursuant thereto, the applicant joined as Assistant Professor (Lecturer) on 26.02.2007 on being relieved from the post of Associate Professor (erstwhile Assistant Professor) on contract.

4. Probation of the applicant was cleared vide order dated

20.01.2009 (Annexure A-4). Applicant was granted the Senior Scale w.e.f. 26.02.2012 vide order dated on 21.10.2014 (Annexure A-5) and Selection Grade vide Chandigarh Administration Order dated 02.02.2018 (Annexure A-6). Financial Upgradations (Promotion under CAS) have been stated to be granted under the rules and the applicant is due for retirement on 31.03.2030.

5. While granting the financial upgradations of Sr. Scale and Selection Grade, previous service w.e.f. 08.12.2004 to 25.02.2007 rendered, in the same College, on contract is not counted. As per Govt of In
