The instant Original Application has been filed by the applicant under Section 19 of the Administrative Tribunals Act, 1985 seeking following relief:-

“In view of above submission it is most respectfully prayed that this Original Application may kindly be allowed and the impugned order dated 25/26.04.2024 (Annex. A/1) may kindly be quashed and set aside. It is further prayed that the respondent Sangathan may kindly be directed to consider the request of the applicant to accommodate him to Sikar or nearby location i.e. Jaipur under spouse ground in terms of Office Memorandum dated 30.09.2009 and the provisions of Transfer Guidelines, 2023.”

2. Facts of the case in brief are as under:-

2.1 The applicant joined the respondents-Sangathan as a PRT on 12.01.2011. He was posted to K.V. NHPC Singtam East Sikkim (which is a Hard Station) and he served there from 12.01.2011 to 28.06.2014. Thereafter, after completing the tenure at Hard Station, he was posted to K.V. No. 2, Jaipur, on his request as per the Transfer Guidelines. His wife is a State Government employee and is posted at Government Girls Senior Secondary School, Ajeetgarh, P.S. Srimadhopur, District Sikar as School Lecturer (Biology).

2.2 The respondent-Sangathan vide Notification Dated 30.06.2023 has issued the Transfer Policy of 2023 whereby the teachers were required to fill the online transfer application. The applicant submitted his transfer application (Phase-I) on 15.07.2023 wherein he mentioned his date of joining in the present station i.e. Jaipur as 07.10.2019 and accordingly
