Being aggrieved by the Order Nos.(i) B-2/12 Rule-

14/RMD/08/2009 dated 27.08.2009 (Annexure-A/1); (ii)No.B/Rule-14/3/RMD/08/2009-2014 dated 29.05.2014 (Annexure-A/2); (iii) STA-20/14/2014 dated 14.01.2015 (Annexure-A/3); (iv) Staff/31-14/201/2016 dated 22.03.2017 (Annexure-A/4), the applicant has filed the present OA under Section 19 of the Administrative Tribunal Act, 1965 seeking following relief:-

“i) May be pleased to admit and allow this original app ii) May pleased to declare the impugned Orders No. a) B-2/12/Rule-14/RMD/08/2009 dated 27-8- 2009 issued by Supdt. of Post-Offices, Amieli and annexed at Annexure A-1.

b) B/Rule-14/3/RMD/2009-2014 dated 29-5-2014 issued by Supdt. of Post-Offices, Amreli and annexed at Annexure A-

c) STA-20/14/2014 dated 14-1-2015 issued by Director Postal Services, Rajkot and annexed at Annexure A-3.

d) Staff/31-14/201/2016 dated 22-3-2017 issued by Chief Postmaster General, Gujarat Circle, Ahmedabad and annexed at Annexure A-4 as as unjust, unfair, unconstitutional, unreasonable, arbitry, vindictive, discriminative and bad in law and to quash and set-aside the same.

iii) May be pleased to direct the respondents to regularise pay of the applicant from 1-7-2014 and effect payment of arears thereof.

iv) May be peased to direct the respondents to refund entire amount to the applicant already recovered from him.

and v) May be pleased to pass such other and further orders as deemed appropriate.”

2. Brief facts of the case of the applicant are as follows:-

2.1 The applicant was recruited as a Postal Assistant in the Amreli Postal Division and was posted as Chalala Sub Post Office w.e.f. 06.07.1998. Thereafter, he was transferred as a Postal Assistant in Damnagar Sub Post Office to Amreli Head Post Office and presently he was working in Amreli Head Post Office.

2.2 The applicant was served Charge Sheet under Rule 14 of CCS (CCA) Rules, 1965 vide Supdt. Of Post Offices, Amreli, Charge Memorandum dated 27.08.2009 (Annexure- A/1). He further submitted that the alleged charges were framed under Article-1 of the impugned Charge Memorandum wherein the applicant while working as Counter Postal Assistant at R.D. Counter at Amreli Head Post Office during the period from 13.06.2006 to 14.10.2008 had committed different kinds of irregularities in withdrawals/closures of R.D. Accounts and thereby he was alleged to had acted in violation of Post-Office Savings Bank Manual Vol. I as well as other Savings Bank orders and he was charged for violation of Rule

3(1) (i), (ii), (iii) of CCs (Conduct) Rules, 1964.

2.3 Thereafter, the applicant denied all the charges and submitted defence statement on 11.09.2009 which was rejected by the Disciplinary Authority; appointed Inquiry Officer and Presenting Officer to initiate the Departmental inquiry against the applicant.
