O R D E R

This Original Application has been filed under Section 19 of the Administrative Tribunal’s Act. 1985 to claim the following reliefs:

“ i) Issue a writ or order or direction in certiorari or any other writ or order or direction quashing the order bearing no CSIR-NAL/Admin-ADB/2020-21 dated 13.07.2020 (Annexure 15), order bearing no CSIR-NAL/ Admin- ADB/2020-21 dated

04.09.2020 (Annexure 17), order bearing по ADB(Estt)/53573/RNCAC dated 25.07.2022 (Annexure 20), order bearing no AII/53573/Sec IV dated 05.04.2023(Annexure 23) passed by the respondent no 3 refusing a switchover from CPF to GPF scheme for the applicant.

ii) Issue a writ or order or direction in certiorari or any other writ or order or direction directing the respondents no 1-5 to consider the request of the applicant for switchover from CPF to GPF scheme as per his representations.

iii) Grant such other reliefs as may deem fit in the circumstances of the case;”

2. The reliefs are claimed based on the grounds as mentioned in paragraphs 5(a) to (d) of the Original Application. The brief facts of the case of the applicant, as mentioned in the synopsis of the O. A are that the applicant came to be appointed as Scientist/Engineer-SC vide appointment letter dated 03.11.2000 and joined services on 04.12.2000 at the Indian Space Research Organisation, Sriharikota. Pursuant to the appointment order, the applicant reported for duty and after completion of his probationary period, his services came to be confirmed in the said post. As per the cadre and recruitment rules of the respondent institution, the next promotional post is from the post of Scientist/Engineer SC to SD. The applicant, by virtue of residency period and merit, became fully qualified and eligible for promotion to the next higher cadre as he was not suffering from any disqualification. Accordingly, the applicant came to be promoted from time to time by virtue of his seniority.

3. The respondent No.6 Organization then issued an O. M dated 16.07.2001 titled "Exercise of Option-Switchover to GPF and Pension Scheme from CPF in respect of Scientific and Technical Personnel" to the applicant. The O. M further read as "If no option in writing to retain the CPF scheme is received in Administration as above, he/she will be brought under the GPF scheme automatically on completion of 20 years of service without further intimation."

4. The applicant later expressed his desire to join the NAL, i.e., the respondent no 3 organization, through proper channel. In this regard, the respondent no. 6 organization, issued a No Objection Certificate to the applicant granting him permission to apply for the post of Scientist, Gr IV (2) at National Aerospace Laboratories, Bangalore.
