1. The applicant has preferred this instant O.A against impugned order dated 30.09.2025 (Annexure A-1) whereby the applicant has been transferred and relieved with effect from 30.09.2025 (A/N) from Chandigarh to Faridkot, under section 19 of the Administrative Tribunals Act, 1985 seeking the following relief: “i) That respondents be directed to produce complete record of the case alongwith file notings to show to this Hon'ble Court the proposal/names of officials/Motor Transport Drivers having longer stay, made by the Motor Transport Officer O/o respondent No.3 to the Transfer Committee for recommendations/approval for kind perusal of this Hon'ble Court.

ii) That impugned order dated 30.09.2025 (A-1) transferring the applicant from SIB Hqrs. Chandigarh to Faridkot as well as his relieving on the same date i.e. 30.09.2025 (A/N) be quashed/set-aside.

iii) That direction in the nature of mandamus be issued to respondent authorities to allow the applicant to continue working in his present place of posting i.e. Chandigarh without any impediment in the interest of justice.”

Brief facts of the case as submitted by the applicant are that the applicant was initially appointed as Junior Intelligence Officer–II/MT in the Subsidiary Intelligence Bureau (SIB), Chandigarh under the Ministry of Home Affairs and joined service on 03.11.1998. He was initially posted at Jalandhar and has been serving under Respondent No.3 since then. The applicant was granted his 1st financial upgradation under the MACP Scheme w.e.f. 03.11.2008 in the pay band of Rs.5200–20200/- with Grade Pay of Rs.2800/- on completion of 10 years of service. Thereafter, he was promoted to the post of JIO-I/MT vide IB Headquarters Order dated 12.04.2016, as reflected in the consequential order dated 16.06.2016 (Annexure A-2).

3. The applicant contends that ever since his appointment, he has been subjected to repeated and frequent transfers. A detailed tabular record of transfers from 1998 till 2025 has been placed on record (page Nos.3-4 of the paperbook), showing that the applicant has undergone 19 transfers during his service career. These include transfers between Jalandhar, Hisar, Ambala, Chandigarh, Faridabad, Yamuna Nagar, Haridwar, Leh, Demchok, and other stations under SIB Chandigarh. It is submitted that the applicant has always complied with each transfer order without protest.

4. The applicant states that, being a motor transport/LMV driver, he had started facing serious difficulty in driving due to his eyesight.

Upon consultation at LJ Eye Institute, Ambala, he was diagnosed with White Cataract in both eyes, requiring surgical intervention. Consequently, he underwent cataract surgery of the left eye on 05.09.2025, as evidenced by the discharge summary (Annexure A-3). The attending doctors also advised cataract surgery for the right eye, the same was planned for the end of October 2025, after Diwali.
