ORDER (ORAL)

By Hon’ble Dr. Chhabilendra Roul, Member (A):-

Present OA has been filed by the applicants under Section 19 of the Administrative Tribunals Act 1985, seeking the following reliefs:-

“(i) Quash and set aside the following impugned Memorandums/Rejection Letters issued by the respondents in respect of the applicants denying the benefit of GPF/Pension Scheme:

a. KVS Regional Office response dated 10.05.2022 Memorandum F.No. 110125/2021/201/Ms. P. Rani Chawla, Retd. PRT/CC/KVS-PF/11 dated 13/25.04.2022 to the Legal Notice dated 21.05.2018; b. KVS Regional Office response dated 10.05.2022 Memorandum F.No. 110125/2021/201/Ms. Shashi Manral, Retd. TGT/CC/KVS-PF/22 dated 22/25.04.2022 to the Legal Notice dated 21.05.2018; c. KVS Regional Office response dated 10.05.2022 Memorandum F.No. 110125/2021/201/Ms. Ranjana Thakur, Retd. HM/CC/KVS-PF/23 dated 22/25.04.2022 to the Legal Notice dated 21.05.2018; d. KVS F.No. 110125//2019/K.V.S/CPF to GPF/515 dated 13/24.05/2019 in respect of the applicant no.4's Request Letter dated 24.04.2019;

e. KVS F.No. 110125/2015/KVS/CPF to GPF/GR.KVS/2268 dated 15.03.2016 in respect of the applicant no.5's Request Letter dated

26.02.2016;

(ii) Pass an order declaring to the effect that the whole action/inaction of the respondents in not accepting the request/representations of the DAYAWAT applicants for considering them to have 'automatically come-over' to the GPF/Pension Scheme as arbitrary, unfair and illegal, being discriminatory and contrary to the words and spirit of the well-

reasoned judicial pronouncements in similar cases;

(iii) Pass an appropriate order/direction declaring the applicants to have 'automatically come-over' to the GPF/Pension Scheme w.e.f. 01.01.1986 in compliance of the provisions of the KVS Office Memorandum F.No.152-1/79- 80/KVS/Budget/Part.II dated 01.09.1988, they (the applicants) having not exercised option for their continuance in the CPF Scheme during the KVS prescribed period i.e., 01.09.1988 to 31.01.1989;

(iv) Consequent to the above clauses (i) and (ii), hold and declare that the Applicants are entitled for pension and all other retirement benefits as admissible to the similarly placed teachers/employees of KVS under the CCS (Pension)
