The present Original Application had been filed by the Applicant, who had succeeded at the Civil Services Examination (C.S.E.)- 2021 conducted by the Union Public Service Commission (U.P.S.C.) with a Rank No.446 – against non-allocation of any Serviceto him, sinceat the pre-requisite Medical Examination for him as a ‘Person with Benchmark Disability’ (PwBD) category, he was found not to fulfill Functional Classification (FC) and Physical Requirement (PR) of the posts/Services available at his turn.

2. Based on the pleadings of the parties, the relevant matrix of facts had emerged to be as follows, briefly. The Applicant had applied at the C.S.E.-2021 as a PwBD candidate under Sub- category Locomotor Disability including Cerebral Palsy (L.D.C.P.) whereupon he was declared successful at the C.S.E.-2021 by the U.P.S.C. with Rank No.446. Consequently, he had undergone the General Medical Examination on 27.04.2022 by the Central Standing Medical Board (C.S.M.B.) at Safadarjung Hospital, New Delhi – wherein the Applicant was found as ‘Fit for non-technical Services’, with specific mention of his sub-standard height and PwBD category (L.D.C.P. Sub-category 75%) ; and found to be ‘Unfit for technical Services’ due to sub-standard height. As additionally prescribed for PwBD candidates, he was also examined/tested by the Benchmark Disability Expert Panel (B.D.E.P.) at All-India Institute of Medical Sciences (A.I.I.M.S.), New Delhi on 28.04.2022 – wherein after due medical evaluation of his disability, inter alia of the various functional parameters and physical requirements, he was found to be a candidate under L.D.C.P.
