Per: Suchitto Kumar Das, Administrative Member The applicant has approached this Tribunal under Section 19 of the Administrative Tribunals Act, 1985, praying for the following relief(s): “8(a) An order or direction upon the Respondents to dispose of the pending representation dated 02.12.2024 pertaining to the claim of the applicant for issue and grant of family pension other than wife as being the unmarried, unemployed daughter of their employee, late Sartya Ranjan Sen alias Sengupta.

(b) An order or direction upon the Respondents to treat the applicant as the daughter of late Sartya Ranjan Sen alias Sengupta and late Bani Sen alias Sengupta on the basis of the available document/certificate submitted by the applicant and available on their records.

(c ) An order or direction upon the Respondents to issue and grant the family pension other than wife to the applicant at the earliest with all consequential benefits.

(d) Costs or incidental to and arising out of this application.

(e ) Any other order or orders as your Lordships may deem fit and proper by way of molding reliefs.”

2. During the course of hearing, learned counsel for the applicant has drawn our attention to the letter dated 26.10.2022 (Annexure A/4) whereby the Asstt. Director General of Foreign Trade requested to the Regional Pay & Accounts Officer, Ministry of Commerce & Industry for grant of family pension to Smt. Ratna Sengupta, unmarried daughter of late Satya Ranjan Sengupta. However, till date neither the applicant has been received family pension nor any communication from the respondents.

3. At this stage, learned counsel for the applicant submits that his purpose would be served, if the respondent’s authority is directed to take a final decision with regard to the claim of the applicant within a stipulated period of time.

4. Learned counsel for the respondents submits that they are verifying the documents and will take necessary steps very soon.

5. In view of above, we direct the Respondent No. 2 & 5 or any other Competent Respondent Authority to take a final decision with regard to the family pension of the applicant and to make payment thereafter, if nothing come in the way, by passing a reasoned and speaking order, within a period of 03 months from the date of receipt of copy of this order.

6. Accordingly, OA stands disposed of with no order as to costs.
