The present OA has been filed by the applicant under section 19 of the Administrative Tribunal Act, 1985 seeking the following relief:

“a) quashing Office Order bearing No.91/2024, dated

26.3.2024;

b) directing Respondents to convene meeting of Screening Committee in case of Applicant to consider grant of 3rd Financial Upgradation to Applicant under MACP Scheme w.e.f. 21.10.2016, as per time frame fixed by this Hon’ble Tribunal;

c) directing Respondents to correct the date of direct recruitment of Applicant to actual date of “21.10.1986”, instead of wrongly recorded date as “29.10.16”, in the entry made in the Service Book of Applicant, w.r.t. Office Order no.251/2016 dated 30.9.2016, as per timeframe fixed by this Hon’ble Tribunal;

d) award cost of these proceedings to Applicant; and e) pass any other order(s) that this Hon’ble Tribunal may deem fit in the facts & circumstances of the case.”

2. Factual Matrix

2.1 The applicant was appointed as Stenographer Grade-III with the respondents on 7.1.1984. He was promoted to the Grade of Stenographer Grade-II on 21.10.1986 and to Stenographer Grade-I on 26.5.2003. The applicant represented to the respondents on 11.11.2013 for correction of his mode of recruitment to that of direct recruitment, instead of by way of promotion. The respondents issued order dated 30.9.2016 correcting the mode of recruitment of the applicant with effect from 21.10.1986 to direct recruitment. Subsequently, he represented on 1.8.2017 to the respondents for placing his case before the screening committee for grant of 3rd financial upgradation, followed by another representation dated 12.3.2021 and 17.1.2023 after being refused to correct his mode of recruitment. After not getting relief from the respondents, the applicant filed OA No.289/2024 seeking grant of 3rd financial upgradation under the MACP Scheme. This Tribunal vide order dated 1.2.2024 directed the Respondents to consider the pending representation of the applicant to pass appropriate speaking order within a stipulated period of eight weeks. The respondents vide order dated 26.3.2024 had intimated him that he had already been granted 3rd financial upgradation w.e.f 7.10.2014 after completing 30 years reckoning his service with respondents w.e.f 7.1.1984. However, the grievance of the applicant remained unconsidered as the respondents treated his “Direct Recruitment” to Grade-II Stenographer on 21.10.1986 as promotion. Being aggrieved, the applicant has filed the present OA seeking the aforementioned relief.

3. Notices were issued to the respondents and they have filed their counter reply, to which the applicant has also filed his rejoinder.
