ORAL ORDER

In the instant OA, the applicant seeks the following relief:

“(i) To direct the respondents to grant compassionate allowance to the deceased husband of the applicant from the date of his removal from service and to grant compassionate allowance/ family pension to the applicant from the date of death of her husband along with arrears and all consequential benefits as if it is deemed that her husband was granted the compassionate allowance and (ii) To pass such further or other orders as this Hon'ble Tribunal may deem fit and proper in the circumstances of the case with cost.”

When the matter is taken up for admission hearing, the learned counsel for the applicant submits that the applicant had filed OA 751/2017 and this Tribunal vide order dated 30.11.2023 passed an order quashing the impugned order dated 18.12.2014 directing the respondents to consider the case of the applicant for grant of Compassionate Allowance in the light of the case of Mahinder Dutt Sharma, 2014(11) SCC 684. However, the respondents did not pass any order. Meanwhile, the applicant expired on 04.08.2024. Thereafter, the wife of the deceased employee gave a representation on 11.02.2025 to the respondents which is still pending consideration. Therefore, the learned counsel for the applicant submitted that the applicant would be satisfied if a direction is given to the respondents to consider and dispose of her representation within a timeframe to be stipulated by this Tribunal.

3. Mr. S. Nagarajan, learned counsel, submits that he does not have any objection for issuing the direction as above.

4. In view of the limited relief sought as above, OA is disposed of at the admission stage without entering into the merits of the case, with a direction to the respondents to dispose of the representation given by the applicant on 11.02.2025 and pass a speaking order thereon within a period of three months from the date of receipt of a copy of this order.

5. The OA is disposed of on the above lines at the admission stage.
