The Applicants herein are officers of the erstwhile Municipal Corporation of Delhi. The erstwhile Municipal Corporation of Delhi was trifurcated in the year 2011 into three Corporations viz. North Delhi Municipal Corporation, South Delhi Municipal Corporation and East Delhi Municipal Corporation. The Respondent No. 1 is the lead Corporation mandated to look after the promotion of the officers of the erstwhile Municipal Corporation of Delhi. The Applicant No. 1 belonging to the Scheduled Caste and Applicant No. 2 belonging to the Scheduled Tribe joined the Municipal Corporation of Delhi as Lower Division Clerks on 01.08.1980 and 01.02.1991 respectively. The Respondent No. 1 has not maintained the roster for the posts as per the Government of India guidelines for reservation in Government service. The Applicants were promoted to the post of Head Clerk on 17.01.2006 and became eligible for promotion to the post of Superintendent w.e.f. 16.01.2011.

2. It is submitted that despite availability of regular vacancies since 16.01.2011, the Applicants, though found eligible and fit by the Departmental Selection Committee in its meeting held on 27.12.2012, were promoted only on ad hoc basis to the post of Superintendent on 16.01.2013.

3. It is submitted that the Applicants, on being found eligible and fit by the Departmental Promotion Committee in its meeting held on 13.02.2014, were granted promotion to the post of Superintendent on regular basis only on 28.02.2014, although they were working against regular vacancies since 16.01.2013. They were thus wrongly denied regular promotion from 16.01.2013.
