Per: Urmita Datta (Sen), Judicial Member The applicant has approached this Tribunal under Section 19 of the Administrative Tribunals Act, 1985, praying for the following relief(s):

“(a) Direction to set aside the rejection order dated 31.03.2025.

(b) Direction to grant higher pension under EPS on the basis of actual salary contributions.

(c ) Direction to extend the benefit of the Hon’ble Supreme Court judgment in Sunil Kumar (04.11.2022).

(d) Any other order deemed fit and proper.

( e) Direction to produce all connected departmental records at the time of hearing.”

2. However, learned counsel for the respondents has raised preliminary objection with regard to jurisdiction of this Tribunal to hear the matter.

3. It has also been submitted by the learned counsel for the respondents that the applicant was the employee of ITC Limited which is a private company.

Therefore, this Tribunal does not have any jurisdiction on the same.

4. Today, learned counsel for the applicant during the course of hearing, has fairly submitted that he wants to withdraw the present OA with liberty to approach before the appropriate forum.

5. Heard learned counsel for both sides and perused the materials on record.

6. It is noted that admittedly the applicant is an ex-employee of ITC Limited. Therefore, this Tribunal does not have any jurisdiction to adjudicate the matter since this is the service dispute of private company.

7. In view of above, the OA is dismissed with liberty to the applicant to take appropriate steps, if so advised.
