Instant OA has been filed by the applicant seeking the following relief:-

“8(I). For directions upon the respondent to send these applicants for medical examination and if they are found suitable in the medical examination, they should be promoted/appointed on the post of Trains Manager (Goods Guard).

8(II). For further direction upon the respondent to fix the seniority as per their merits, if the applicants are successful in medical examination and appointed on the post of Trains Manager (Goods Guard).

8(III). Any other order(s)/direction(s) as Your Lordships may deem fit and proper in the facts and circumstances of this case and in the interest of Justice.

2. As factual matrix of the case the présent applicants. were initially appointed on Group ‘D’ post and thereafter they joined the post in the month of May, 2023 except applicant no.1 who joined the post in September 2019.

3. Pursuant to an advertisement dated 13.05.2024, the applicants being eligible, applied through online mode for the post of MANORDigitally signed by ANJAN MANORAN Trains Manager (Goods Guard). The selection was to be made by a KUMAR JAN SINHAK S U IN M

single stage computer based test (CBT) following by document

verification and medical examination according to prescribed Medical Standard.

4. On receipt of Admit card, applicants appeared for CBT examination on scheduled dates i.e 19.11.2024 and 22.11.2024 and after qualifying in the said test they were called for document verification on the basis of merit in CBT.

5. However, the applicants applied under OBC category but they were shortlisted in the General Category barring Sunil Kumar Saw who was shortlisted in the OBC Category. The applicants presented their relevant documents on the scheduled date which were verified and found to be genuine but contrary to notification, they were not subjected to medical tests and later they were informed that their medical standard were not for category of A/2 as it were found at the time of medical examination for appointment in Group ‘D’ posts hence they have not been sent for medical examination for the pu
