ORAL ORDER

(As per Hon’ble Dr. Lata Baswaraj Patne, Judicial Member)

By this Original Application, the applicant is seeking the following relief:

“This Hon'ble Tribunal in the interests of justice be pleased to declare the action of the respondents in proceeding further in the disciplinary proceedings initiated against the applicant vide Memo dated 11-01-2018 in view of the order of the Hon'ble Tribunal dated 12-02-2016 in O.A./615/2015 as illegal, arbitrary, unreasonable and unconstitutional and consequently direct the respondents not to proceed further against the applicant in the disciplinary proceeding initiated against the applicant in the interest of justice and pass such other and further order or orders as are deemed fit and proper by this Hon'ble Tribunal in the circumstances of the case.”

2. When the matter has been taken up for consideration, there is no representation on behalf of the applicant. However, learned counsel for the respondents has placed on record the instructions received from the department that though this Court has directed to complete the Disciplinary Inquiry within six months, however, the applicant did not co-operate during the investigation of the case as directed in the order dated 12.02.2016 in O.A./615/2015.

3. In spite of the ample opportunities given to the applicant, he has not co- operated in completion of the inquiry. The respondents have challenged the order of the Tribunal in W.P. No.35891 of 2016 before the Hon’ble High Court of A.P. and the same was closed as infructuous on 27.10.2016. Since there is no stay to the departmental inquiry, though the applicant has filed the present O.A., therefore, the applicant’s case has been finalised on 22.08.2019 and he was awarded the punishment of removal from service. In view of the same, nothing survives for adjudication. 4. Therefore, in view of the instructions dated 17.02.2025, we do not find any merit in the matter for adjudication. Accordingly, the O.A. is dismissed as infructuous. No order as to costs.
